Supreme Court Reinstates Dismissed Rajasthan Judicial Magistrate Pinky Meena

In a significant ruling, the Supreme Court of India has allowed the appeal of Pinky Meena, a former judicial magistrate from Rajasthan, who was dismissed from service due to allegations of concealment of prior employment and academic impropriety.

A bench comprising Justices BV Nagarathna and SC Sharma set aside the Rajasthan High Court’s Full Bench decision of 2020, which had terminated her from judicial service. The apex court directed her reinstatement with notional fixation of pay, excluding back wages.

The Court specifically clarified that the High Court must consider the appellant to have successfully completed her probation, and she must be treated as a confirmed employee.

Background:

• Pinky Meena was initially appointed as Teacher Grade-II under the Rajasthan Government’s Education Department on December 30, 2014.

• She later applied for the Civil Judge (Junior Division) post via an advertisement dated November 18, 2017.

• She cleared the exam on November 4, 2018, and was appointed as Civil Judge and Judicial Magistrate on February 11, 2019.

In February 2020, the Registrar (Vigilance) served her a show-cause notice alleging that she:

• Failed to disclose her previous government teaching job in her RJS application.

• Pursued B.Ed. and LL.B. degrees simultaneously, which violated university regulations.

• Completed her LL.M. as a regular student while being employed.

In her defense, Meena argued that she had:

• Resigned from teaching before joining judicial services due to health issues.

• Discontinued her B.Ed. upon realizing it conflicted with the rules.

Despite her explanation, the High Court terminated her service in May 2020, leading her to approach the Supreme Court, which has now ruled in her favor.

न्यायमूर्ति बी.वी. नागरत्ना और न्यायमूर्ति एस.सी. शर्मा की पीठ ने राजस्थान हाईकोर्ट की पूर्ण पीठ द्वारा वर्ष 2020 में किए गए सेवा समाप्ति के आदेश को निरस्त कर दिया और उन्हें पुनः सेवा में बहाल करने का निर्देश दिया, जिसमें वेतन का काल्पनिक निर्धारण किया जाएगा, लेकिन बकाया वेतन नहीं मिलेगा।

न्यायालय ने विशेष रूप से स्पष्ट किया कि हाईकोर्ट को यह मानना होगा कि अपीलकर्ता ने प्रोबेशन अवधि सफलतापूर्वक पूरी कर ली है और उन्हें स्थायी कर्मचारी के रूप में माना जाएगा।

• पिंकी मीणा को राजस्थान सरकार के शिक्षा विभाग में ग्रेड-द्वितीय शिक्षक के पद पर 30 दिसंबर 2014 को नियुक्त किया गया था।

• बाद में उन्होंने सिविल न्यायाधीश (जूनियर डिवीजन) के पद के लिए 18 नवंबर 2017 की विज्ञप्ति के आधार पर आवेदन किया।

• वे 4 नवंबर 2018 को चयनित हुईं और 11 फरवरी 2019 को सिविल जज और न्यायिक मजिस्ट्रेट के रूप में नियुक्त हुईं।

फरवरी 2020 में, रजिस्ट्रार (विजिलेंस) ने उन्हें कारण बताओ नोटिस जारी किया जिसमें आरोप था कि उन्होंने:

• अपने पूर्व सरकारी शिक्षक पद की जानकारी RJS आवेदन में नहीं दी।

• B.Ed. और LL.B. की डिग्रियाँ एक साथ कीं, जो विश्वविद्यालय नियमों का उल्लंघन था।

• नौकरी के दौरान नियमित छात्र के रूप में LL.M. भी पूरी की।

पिंकी मीणा ने अपना पक्ष रखते हुए कहा कि:

• उन्होंने न्यायिक सेवा में आने से पहले स्वास्थ्य कारणों से शिक्षण कार्य से इस्तीफा दे दिया था।

• जब उन्हें नियमों की जानकारी हुई तो उन्होंने B.Ed. की पढ़ाई छोड़ दी।

इसके बावजूद, मई 2020 में राजस्थान हाईकोर्ट की पूर्ण पीठ ने उनकी सेवा समाप्त कर दी, जिसके बाद उन्होंने सुप्रीम कोर्ट का रुख किया और अब न्यायालय ने उनके पक्ष में फैसला सुनाया है।
