22 जुलाई 2026 को सुप्रीम कोर्ट ने सभी राज्यों और केंद्र शासित प्रदेशों को निर्देश दिया था कि वे अपने-अपने क्षेत्राधिकार वाले हाई कोर्टों से परामर्श करने के बाद जिला न्यायपालिका के सदस्यों की सेवानिवृत्ति आयु बढ़ाने के प्रश्न पर विचार करें।

एक अंतरिम व्यवस्था के रूप में सुप्रीम कोर्ट ने कहा था कि जहां राज्य सरकार और संबंधित हाई कोर्ट दोनों सेवानिवृत्ति आयु बढ़ाने पर सहमत हों, वहां न्यायिक अधिकारियों को बढ़ी हुई आयु तक सेवा में बने रहने की अनुमति दी जा सकती है।

22 जुलाई के आदेश में उन अधिकारियों की स्थिति पर भी विचार किया गया था जिनकी सेवानिवृत्ति संबंधित अवधि में हुई थी। सुप्रीम कोर्ट ने कहा था कि जहां राज्य सरकार और संबंधित हाई कोर्ट सेवानिवृत्ति आयु बढ़ाने का निर्णय लेते हैं, वहां बढ़ी हुई सेवानिवृत्ति आयु का लाभ 31 मार्च 2026 से संबंधित व्यवस्था के अनुसार लागू हो सकता है।

हालांकि, केरल में यह व्यवस्था प्रत्येक व्यक्तिगत अधिकारी पर किस प्रकार लागू होगी, यह अंतिम सरकारी आदेश और उसके कार्यान्वयन संबंधी आधिकारिक निर्देशों पर निर्भर करेगा।

इसलिए बिना अंतिम प्रशासनिक निर्देशों की जांच किए यह मान लेना उचित नहीं होगा कि प्रत्येक अधिकारी की सेवा अवधि या स्थिति स्वतः एक समान तरीके से निर्धारित हो चुकी है।

1 सितंबर 2026 को सुप्रीम कोर्ट ने विभिन्न हाई कोर्टों और राज्य सरकारों/केंद्र शासित प्रदेशों द्वारा दिए गए जवाबों पर विचार किया।

सुप्रीम कोर्ट के समक्ष यह जानकारी रखी गई कि अधिकांश हाई कोर्ट न्यायिक अधिकारियों की सेवानिवृत्ति आयु 60 वर्ष से बढ़ाकर 62 वर्ष करने के पक्ष में हैं।

सुप्रीम कोर्ट की कार्यवाही के दौरान एक महत्वपूर्ण मुद्दा यह भी सामने आया कि क्या न्यायिक अधिकारियों की सेवानिवृत्ति आयु को सामान्य राज्य सरकारी कर्मचारियों के समान आधार पर देखा जाना चाहिए।

सुप्रीम कोर्ट ने कार्यवाही के दौरान कहा कि न्यायिक अधिकारी एक अलग और विशिष्ट वर्ग हैं।

न्यायालय ने न्यायिक सेवा की प्रकृति और संरचना पर भी ध्यान दिया तथा यह उल्लेख किया कि अनेक न्यायिक अधिकारी अन्य सरकारी सेवाओं की तुलना में अपेक्षाकृत अधिक आयु में न्यायिक सेवा में प्रवेश करते हैं।

यह टिप्पणी महत्वपूर्ण है क्योंकि सेवानिवृत्ति आयु बढ़ाने के विरोध में यह तर्क दिया गया था कि यदि न्यायिक अधिकारियों की सेवानिवृत्ति आयु बढ़ाई जाती है तो अन्य सरकारी कर्मचारी भी समान मांग कर सकते हैं।

इसके बाद रिपोर्ट किया गया सरकारी आदेश कार्यान्वयन की दृष्टि से अधिक महत्वपूर्ण है क्योंकि उसमें सेवानिवृत्ति आयु को 60 वर्ष से बढ़ाकर 62 वर्ष करने का निर्णय दर्ज किया गया है।


यह निर्णय क्यों महत्वपूर्ण है?

1. अनुभवी न्यायिक अधिकारियों की सेवाएं अधिक समय तक उपलब्ध रहेंगी

इसी प्रकार, सुप्रीम कोर्ट के समक्ष पूरे भारत के लिए सेवानिवृत्ति आयु से जुड़ा व्यापक कानूनी प्रश्न केवल इसलिए अंतिम रूप से समाप्त नहीं माना जा सकता क्योंकि केरल जैसे कुछ राज्यों ने प्रशासनिक निर्णय ले लिए हैं।
