In a significant development, the Supreme Court of India on Thursday granted bail to Kashmiri separatist leader Shabir Ahmed Shah in a terror funding case investigated by the National Investigation Agency (NIA), observing that the prolonged delay in the trial could not justify his continued incarceration.

Background of the Case

Shabir Ahmed Shah was arrested in June 2019 in connection with a terror funding case linked to alleged separatist activities in Jammu and Kashmir. He was later named as an accused in the second supplementary chargesheet filed by the NIA on October 4, 2019.

According to the NIA, Shah allegedly played a key role in building and supporting the separatist movement in Jammu and Kashmir. Investigators claimed that he was involved in activities such as:

  • Raising funds through hawala transactions
  • Paying tribute to families of slain militants
  • Collecting funds through Line of Control (LoC) trade channels
  • Using these funds to fuel subversive and militant activities in the region.

The agency contended that several accused persons, including Shah, were part of a larger conspiracy aimed at raising and channeling funds to create unrest in the Kashmir Valley and to wage war against the Government of India.

Supreme Court’s Observations

A bench comprising Justice Vikram Nath and Justice Sandeep Mehta passed the order granting bail after hearing arguments from both sides. Senior Advocate Colin Gonsalves appeared for Shah, while Senior Advocate Siddharth Luthra represented the NIA.

The Court took note of the long period of incarceration undergone by Shah since his arrest in 2019 and the slow progress of the trial. It was highlighted before the Court that the prosecution has proposed examining around 400 witnesses, making the conclusion of the trial unlikely in the near future.

Considering these circumstances, the bench observed that the delay in the trial was unexplained and that prolonged imprisonment without the possibility of a speedy trial could prejudice the accused.

Earlier Bail Proceedings

Shah had earlier approached the Special NIA Court seeking bail, but his plea was rejected on July 7, 2023. He subsequently challenged the order before the High Court, where his bail plea was also dismissed.

In his appeal before the Supreme Court, Shah argued that:

  • His name did not appear in the main chargesheet or the first supplementary chargesheet.
  • There was insufficient material evidence directly linking him to the alleged conspiracy.
  • His prolonged incarceration without a foreseeable conclusion of trial violated his right to personal liberty.

Significance of the Ruling

The ruling highlights the Supreme Court’s consistent emphasis on the principle that prolonged incarceration without a timely trial can violate the fundamental right to personal liberty under Article 21 of the Constitution.

 

By granting bail in this case, the Court reiterated that delays in criminal trials—especially in cases involving large numbers of witnesses—cannot justify indefinite pre-trial detention, even in serious offences, if the trial is unlikely to conclude within a reasonable time.


आतंकवाद वित्तपोषण मामले में कश्मीरी अलगाववादी नेता शबीर अहमद शाह को सुप्रीम कोर्ट से जमानत, सुनवाई में देरी को माना महत्वपूर्ण कारण

Supreme Court of India ने कश्मीरी अलगाववादी नेता Shabir Ahmed Shah को आतंकवाद वित्तपोषण (टेरर फंडिंग) मामले में जमानत दे दी है। यह मामला National Investigation Agency (NIA) द्वारा दर्ज किया गया था। न्यायालय ने कहा कि मुकदमे की सुनवाई में अत्यधिक देरी और लंबे समय से जारी हिरासत को देखते हुए जमानत दी जाना उचित है।

यह आदेश Justice Vikram Nath और Justice Sandeep Mehta की पीठ ने पारित किया। न्यायालय ने ध्यान दिया कि शाह वर्ष 2019 से हिरासत में हैं और अभियोजन पक्ष द्वारा बड़ी संख्या में गवाहों को प्रस्तुत किए जाने के कारण मुकदमे का जल्द समाप्त होना संभव नहीं दिखता।

मामले की पृष्ठभूमि

शबीर अहमद शाह को जून 2019 में जम्मू-कश्मीर में कथित अलगाववादी गतिविधियों से जुड़े आतंकवाद वित्तपोषण मामले में गिरफ्तार किया गया था। बाद में 4 अक्टूबर 2019 को NIA द्वारा दाखिल दूसरी पूरक आरोपपत्र (supplementary chargesheet) में उन्हें आरोपी बनाया गया।

अभियोजन के अनुसार शाह कथित रूप से ऐसे वित्तीय संसाधन जुटाने में शामिल थे जिनका उपयोग कश्मीर घाटी में अलगाववादी गतिविधियों को बढ़ावा देने और अशांति फैलाने के लिए किया गया।

जांच एजेंसी के अनुसार धन जुटाने के कथित स्रोतों में शामिल थे:

  • हवाला लेनदेन
  • लाइन ऑफ कंट्रोल (LoC) व्यापार से प्राप्त धन
  • आतंकियों के परिवारों को कथित आर्थिक सहायता

एजेंसी का आरोप है कि इन निधियों का उपयोग अलगाववादी गतिविधियों को बनाए रखने और आतंकवादी नेटवर्क को समर्थन देने के लिए किया गया।

सुप्रीम कोर्ट की टिप्पणी

सुनवाई के दौरान अदालत ने शाह की लंबी अवधि की हिरासत और मुकदमे की धीमी प्रगति पर ध्यान दिया। अदालत को बताया गया कि अभियोजन पक्ष लगभग 400 गवाहों को पेश करने की योजना बना रहा है, जिससे मुकदमे के समाप्त होने में कई वर्ष लग सकते हैं।

पीठ ने कहा कि जब मुकदमे के शीघ्र समाप्त होने की संभावना नहीं हो, तब किसी आरोपी को अनिश्चितकाल तक हिरासत में रखना उसके लिए पूर्वाग्रहपूर्ण (prejudicial) हो सकता है।

इसी आधार पर अदालत ने लंबी हिरासत और सुनवाई में देरी को जमानत देने के महत्वपूर्ण कारणों में माना।

पूर्व जमानत कार्यवाही

शाह ने पहले विशेष NIA अदालत में जमानत याचिका दायर की थी, जिसे 7 जुलाई 2023 को खारिज कर दिया गया था। इसके बाद उच्च न्यायालय में भी उनकी जमानत याचिका अस्वीकृत हो गई।

इसके बाद उन्होंने जमानत के लिए सुप्रीम कोर्ट का रुख किया।

शाह की ओर से सीनियर एडवोकेट Colin Gonsalves पेश हुए, जबकि NIA की ओर से सीनियर एडवोकेट Siddharth Luthra ने पक्ष रखा।
