The Rajasthan High Court has dismissed a petition challenging the answer key and results of the 2024 Civil Judge (Preliminary) Examination, reiterating the limited scope of judicial review in academic and competitive evaluation matters.

The judgment was delivered by a Division Bench comprising Justice Arun Monga and Justice Sunil Beniwal, which refused to interfere with the findings of the expert committee that had examined objections to the answer key.

The petitioner, a judiciary aspirant, had approached the Court disputing certain answers in the preliminary examination and sought appropriate corrections in the answer key. However, the Court held that it cannot act as an appellate authority over expert bodies in such matters.

The Bench observed that in issues involving academic evaluation, courts must defer to the opinion of subject experts, especially when multiple reasonable interpretations are possible. It noted that merely because an alternative answer appears plausible does not justify judicial interference.

The Court further stated that where two views are reasonably possible, the view adopted by the expert committee must ordinarily prevail, thereby maintaining consistency and fairness in competitive examinations.

During the hearing, the petitioner specifically challenged a question relating to the rule against double jeopardy, contending that her answer should be accepted as correct. The Court, however, declined to accept her contention and upheld the answer key prepared by the expert committee.

Importantly, the Bench also noted that even if the petitioner’s answer were to be accepted, it would have resulted in only one additional mark, increasing her score from 65 to 66, which was still below the cut-off of 68 marks required to qualify the preliminary examination.

Interestingly, while dismissing the plea, the Court appreciated the petitioner for the commendable manner in which she argued her case, highlighting her clarity and effort despite the outcome.

The petition was ultimately dismissed, with the Court reaffirming that judicial interference in examination matters is permissible only in exceptional cases involving clear illegality or arbitrariness, and not merely on the basis of differing interpretations.

This ruling reinforces the principle that expert bodies hold primacy in academic evaluations, and courts must exercise restraint to ensure the integrity and uniformity of competitive examination processes.

अदालत ने कहा कि शैक्षणिक मूल्यांकन से जुड़े मामलों में विशेषज्ञों की राय को प्राथमिकता दी जानी चाहिए, और केवल इसलिए कि कोई अन्य उत्तर संभव है, हस्तक्षेप उचित नहीं है।

याचिकाकर्ता ने विशेष रूप से double jeopardy के सिद्धांत से संबंधित प्रश्न को चुनौती दी थी, लेकिन अदालत ने इस तर्क को स्वीकार नहीं किया और उत्तर कुंजी को सही माना।

अदालत ने यह भी कहा कि यदि याचिकाकर्ता का उत्तर सही मान भी लिया जाए, तो उसे केवल एक अतिरिक्त अंक मिलेगा, जिससे उसका कुल स्कोर 65 से बढ़कर 66 हो जाएगा, जो कि कट-ऑफ 68 अंकों से कम है।

दिलचस्प रूप से, अदालत ने याचिका खारिज करते हुए भी याचिकाकर्ता की तर्क प्रस्तुत करने की शैली की सराहना की।

अंततः अदालत ने याचिका खारिज करते हुए कहा कि परीक्षा संबंधी मामलों में न्यायिक हस्तक्षेप केवल असाधारण परिस्थितियों में ही किया जा सकता है, न कि अलग-अलग व्याख्याओं के आधार पर।

 

यह निर्णय स्पष्ट करता है कि शैक्षणिक मूल्यांकन में विशेषज्ञ समितियों की प्राथमिकता होती है और न्यायालयों को ऐसे मामलों में संयम बरतना चाहिए।
