In a significant judgment raising serious concerns about investigative standards and misuse of criminal law, the Fast Track Court, Jammu, has acquitted a man accused of rape and directed departmental and criminal action against the Investigating Officer, the complainant, and certain individuals who allegedly played a role in facilitating what the Court described as a false prosecution.

The judgment was delivered on May 29, 2026, by Presiding Officer Amarjeet Singh Langeh in a case arising out of FIR No. 90/2022 registered at Police Station R.S Pura, Jammu, under Section 376 of the Indian Penal Code (IPC).

Background Of The Case

The prosecution alleged that the accused, who was the complainant's maternal uncle, entered her room during the intervening night of May 13-14, 2022, and committed rape.

Based on the complaint, police registered an FIR and subsequently filed a chargesheet against the accused under Section 376 IPC.

The trial proceeded before the Fast Track Court after charges were framed and multiple prosecution witnesses were examined.

Court Finds Prosecution Story Highly Improbable

After examining the evidence, the Court found substantial inconsistencies and improbabilities in the prosecution case.

The Court noted that according to the prosecutrix, the alleged incident occurred in a house occupied by several family members, including her parents and uncles. Despite the allegation that the accused remained in her room for a considerable period and raped her twice, no family member allegedly heard any cries for help.

The Court observed that such a version was difficult to reconcile with normal human conduct and the surrounding circumstances.

According to the judgment, the prosecutrix claimed that she did not immediately disclose the alleged incident to her parents but instead contacted her brother and later NGO workers who became involved in the matter. The Court considered this conduct unusual and found it raised serious doubts regarding the prosecution version.

Medical Evidence Did Not Support Allegations

One of the major factors influencing the Court's decision was the medical evidence.

The prosecutrix was medically examined on the same day the FIR was registered. However, the medical report reportedly revealed:

  • No marks of violence;
  • No injuries;
  • No evidence of recent sexual intercourse.

The Court observed that such findings significantly weakened the prosecution case, particularly when the allegation involved repeated sexual assault.

Court Criticizes Investigation

The Court delivered strong criticism of the investigation conducted by the police.

According to the judgment:

  • The Investigating Officer visited the alleged crime scene after considerable delay;
  • CCTV footage was allegedly collected but not properly analyzed;
  • Important witnesses were not examined;
  • Relevant electronic evidence was not secured;
  • Several investigative lapses remained unexplained.

The Court held that the investigation appeared "fabricated", "botched", "deliberately manipulated" and "tainted".

Observations Regarding NGO Workers

The Court also scrutinized the role played by two individuals associated with an NGO.

According to the judgment, the evidence suggested that these individuals played an unusually active role in facilitating the registration and continuation of the criminal case.

The Court observed that the FIR appeared to have been influenced by external intervention rather than emerging spontaneously from the complainant or her family.

The Court expressed concern regarding the possibility of misuse of legal processes through such intervention.

Accused Acquitted After Nearly 20 Months In Custody

The Court noted that the accused had spent approximately one year, seven months and eleven days in incarceration before securing bail.

Ultimately, the Court concluded that the prosecution had failed to prove the charge beyond reasonable doubt and held that there was no reliable evidence establishing that the alleged occurrence had taken place.

Accordingly, the accused was acquitted of all charges.

Departmental Inquiry Ordered Against Police Officials

While acquitting the accused, the Court directed the Inspector General of Police, Jammu, to initiate a departmental inquiry against:

  • The Investigating Officer;
  • The then SHO of Police Station R.S Pura.

The Court directed that the inquiry be concluded in accordance with law at the earliest.

Action Ordered Against Complainant

The Court further directed the Senior Superintendent of Police, Jammu, to initiate proceedings under Section 182 RPC against the complainant for allegedly furnishing false information.

The SSP was also directed to conduct an inquiry regarding the involvement of the NGO-linked witnesses and, if wrongdoing is established, initiate appropriate criminal action in accordance with law.

Significance Of The Judgment

The ruling is likely to generate discussion on:

  • Investigative accountability;
  • False criminal prosecutions;
  • Safeguards against misuse of rape laws;
  • Role of third-party intervention in criminal complaints;
  • Protection of both victims' rights and rights of the accused.

The judgment reiterates that while allegations of sexual offences must be investigated with utmost seriousness, criminal convictions can only be sustained on credible, reliable, and legally admissible evidence.

झूठे दुष्कर्म मामले में जम्मू कोर्ट ने आरोपी को बरी किया, पुलिस अधिकारी, शिकायतकर्ता और NGO कर्मियों के खिलाफ कार्रवाई के आदेश

एक महत्वपूर्ण फैसले में फास्ट ट्रैक कोर्ट, जम्मू ने कथित दुष्कर्म मामले में आरोपी को बरी करते हुए जांच अधिकारी, शिकायतकर्ता तथा मामले से जुड़े कुछ NGO कर्मियों के विरुद्ध कार्रवाई के निर्देश दिए हैं।

यह फैसला 29 मई 2026 को प्रेसाइडिंग ऑफिसर अमरजीत सिंह लंगेह द्वारा सुनाया गया। मामला FIR संख्या 90/2022, थाना आर.एस. पुरा, जम्मू से संबंधित था, जिसमें आरोपी पर भारतीय दंड संहिता की धारा 376 के तहत आरोप लगाए गए थे।

मामले की पृष्ठभूमि

अभियोजन पक्ष के अनुसार, शिकायतकर्ता ने आरोप लगाया था कि उसके चाचा ने 13-14 मई 2022 की रात उसके कमरे में प्रवेश कर उसके साथ दुष्कर्म किया।

शिकायत के आधार पर पुलिस ने FIR दर्ज कर जांच के बाद आरोपी के विरुद्ध चालान पेश किया।

अदालत ने कहानी को अविश्वसनीय माना

अदालत ने पाया कि कथित घटना ऐसे घर में हुई बताई गई जहां कई अन्य परिवारजन भी रहते थे।

फिर भी किसी ने कोई शोर-शराबा या सहायता की पुकार नहीं सुनी।

अदालत ने कहा कि यह परिस्थितियां अभियोजन की कहानी को अत्यंत संदिग्ध बनाती हैं।

मेडिकल साक्ष्य ने आरोपों का समर्थन नहीं किया

अदालत ने विशेष रूप से इस तथ्य पर ध्यान दिया कि पीड़िता की मेडिकल जांच में:

  • किसी प्रकार की चोट नहीं मिली,
  • हिंसा के निशान नहीं मिले,
  • हालिया यौन संबंध का कोई चिकित्सीय प्रमाण नहीं मिला।

अदालत ने कहा कि यह तथ्य अभियोजन मामले को गंभीर रूप से कमजोर करता है।

जांच पर कड़ी टिप्पणी

अदालत ने जांच को "tainted", "fabricated", "botched" और "deliberately manipulated" बताया।

अदालत ने पाया कि:

  • CCTV साक्ष्य का उचित विश्लेषण नहीं किया गया,
  • महत्वपूर्ण गवाहों को शामिल नहीं किया गया,
  • इलेक्ट्रॉनिक रिकॉर्ड सुरक्षित नहीं किए गए,
  • कई जांच संबंधी खामियों का कोई संतोषजनक स्पष्टीकरण नहीं दिया गया।

NGO कर्मियों की भूमिका पर सवाल

फैसले में अदालत ने दो NGO-संबद्ध व्यक्तियों की भूमिका पर भी गंभीर प्रश्न उठाए।

अदालत ने कहा कि उपलब्ध साक्ष्य से प्रतीत होता है कि FIR दर्ज कराने और मामले को आगे बढ़ाने में इन व्यक्तियों ने अत्यधिक सक्रिय भूमिका निभाई।

अदालत ने इसे चिंताजनक बताया और कहा कि यदि बाहरी हस्तक्षेप के कारण आपराधिक प्रक्रिया प्रभावित होती है तो यह न्याय व्यवस्था के लिए गंभीर चिंता का विषय है।

करीब 20 महीने जेल में रहने के बाद बरी

अदालत ने उल्लेख किया कि आरोपी लगभग एक वर्ष सात माह ग्यारह दिन जेल में रहा।

सभी साक्ष्यों का मूल्यांकन करने के बाद अदालत ने निष्कर्ष निकाला कि अभियोजन पक्ष आरोप सिद्ध करने में पूरी तरह विफल रहा है और आरोपी को बरी कर दिया।

पुलिस अधिकारियों के खिलाफ विभागीय जांच के आदेश

अदालत ने आईजीपी जम्मू को निर्देश दिया कि वे:

  • जांच अधिकारी,
  • तत्कालीन SHO, थाना आर.एस. पुरा

के विरुद्ध विभागीय जांच शुरू करें।

शिकायतकर्ता के खिलाफ कार्रवाई के निर्देश

अदालत ने SSP जम्मू को निर्देश दिया कि शिकायतकर्ता के विरुद्ध धारा 182 RPC के तहत कार्रवाई प्रारंभ की जाए।

साथ ही NGO से जुड़े गवाहों की भूमिका की भी जांच की जाए और यदि आरोप सही पाए जाएं तो उनके विरुद्ध भी कानून के अनुसार कार्रवाई की जाए।

फैसले का महत्व

यह निर्णय निम्न मुद्दों पर महत्वपूर्ण चर्चा को जन्म दे सकता है:

  • पुलिस जांच की जवाबदेही,
  • झूठे आपराधिक मामलों की रोकथाम,
  • यौन अपराध मामलों में निष्पक्ष जांच,
  • आरोपी और पीड़ित दोनों के अधिकारों का संतुलन,
  • आपराधिक न्याय प्रणाली में विश्वसनीय साक्ष्य का महत्व।

अदालत ने स्पष्ट किया कि यौन अपराधों के आरोपों की गंभीरता से जांच आवश्यक है, लेकिन दोषसिद्धि केवल विश्वसनीय और कानूनी रूप से स्वीकार्य साक्ष्यों के आधार पर ही की जा सकती है।
