In a major policy move aimed at regulating emerging digital technologies, the Central Government has notified amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to specifically regulate AI-generated and synthetically created digital content. The updated framework significantly strengthens compliance obligations for social media platforms and digital intermediaries dealing with artificial intelligence-driven media.

A key feature of the amendment is the introduction of a formal definition of “synthetically generated information”, covering audio-visual or digital content that is artificially created, modified, or altered using computer resources in a manner that may appear authentic or real. This brings deepfakes, AI-generated visuals, and manipulated digital content explicitly within the regulatory scope of IT Rules.

The amended rules require clear labelling of AI-generated content so users can distinguish synthetic media from genuine information. Authorities have emphasised transparency as essential to curb misinformation, impersonation risks, and deceptive online narratives linked to AI tools.

Another significant change is the shortened content-takedown timeline. Platforms must now remove flagged unlawful content — including deepfakes and synthetic media — within about three hours of notification, a sharp reduction from earlier timelines that could extend up to 36 hours. The move aims to prevent rapid viral spread of misleading or harmful digital content.

The amendments, notified by the Ministry of Electronics and Information Technology, are expected to come into force shortly and will require major social media platforms, AI developers, and digital intermediaries to update compliance systems, moderation mechanisms, and disclosure practices.

However, digital rights advocates have raised concerns about potential over-regulation, compliance burdens, and risks to online free expression, particularly given the compressed takedown timelines and expanded liability for intermediaries.

Legal experts suggest the amendments reflect India’s attempt to balance technological innovation, misinformation control, user safety, and platform accountability as artificial intelligence becomes increasingly embedded in digital communication.


सरकार ने AI-जनित कंटेंट पर IT नियमों में संशोधन किया — सिंथेटिक मीडिया के नियमन की नई व्यवस्था

डिजिटल तकनीक और कृत्रिम बुद्धिमत्ता के बढ़ते उपयोग को ध्यान में रखते हुए केंद्र सरकार ने सूचना प्रौद्योगिकी (मध्यस्थ दिशानिर्देश एवं डिजिटल मीडिया आचार संहिता) नियम, 2021 में संशोधन अधिसूचित किए हैं, जिनका उद्देश्य AI-जनित और सिंथेटिक डिजिटल कंटेंट को नियंत्रित करना है। इससे सोशल मीडिया प्लेटफॉर्म और डिजिटल इंटरमीडियरी पर नई अनुपालन जिम्मेदारियाँ लागू होंगी।

संशोधन में पहली बार “सिंथेटिकली जनरेटेड सूचना” की स्पष्ट परिभाषा जोड़ी गई है, जिसमें AI द्वारा निर्मित, संशोधित या परिवर्तित ऑडियो-विजुअल तथा अन्य डिजिटल सामग्री शामिल है। इससे डीपफेक और AI-निर्मित कंटेंट सीधे IT नियमों के दायरे में आ गए हैं।

नए नियमों के अनुसार प्लेटफॉर्म को AI-जनित सामग्री पर स्पष्ट लेबलिंग सुनिश्चित करनी होगी ताकि उपयोगकर्ता वास्तविक और कृत्रिम सामग्री में अंतर कर सकें। इसका उद्देश्य फर्जी खबरों, गलत सूचना और डिजिटल धोखाधड़ी को कम करना है।

इसके अलावा, संशोधित नियमों में आपत्तिजनक या अवैध कंटेंट हटाने की समयसीमा को काफी घटाकर लगभग तीन घंटे कर दिया गया है, ताकि भ्रामक या हानिकारक सामग्री के तेज प्रसार को रोका जा सके।

 

विशेषज्ञों का मानना है कि यह कदम डिजिटल पारदर्शिता, जिम्मेदार AI उपयोग और प्लेटफॉर्म जवाबदेही बढ़ाने की दिशा में महत्वपूर्ण है, हालांकि कुछ विशेषज्ञों ने अभिव्यक्ति की स्वतंत्रता और अनुपालन बोझ को लेकर चिंता भी जताई है।
