The Bar Council of India (BCI) has issued a stern warning against unethical legal advertising and misleading promotions by advocates through social media and digital platforms. The BCI condemned the involvement of Bollywood actors, celebrities, and influencers in promoting legal services, highlighting these actions as a violation of professional ethics under the Advocates Act, 1961 and the Bar Council of India Rules.

BCI’s Stance on Legal Advertising and Promotions

The Bar Council of India, leveraging its statutory powers, strongly criticized the rising trend of legal professionals using social media, promotional videos, and influencer endorsements to market their services. BCI also denounced the use of Bollywood actors and celebrities for such promotions, which violates Rule 36, Chapter II, Part VI of the BCI Rules. The Council emphasized that these practices, which involve using religious, cultural, or public events for self-promotion, amount to unethical canvassing and tarnish the dignity of the legal profession.

Concerns About Legal Influencers and Misinformation

The rise of self-styled legal influencers has raised significant concerns regarding the dissemination of misleading legal advice. BCI expressed deep concern over individuals without appropriate credentials spreading misinformation on topics such as matrimonial disputes, taxation, intellectual property rights, citizenship laws, privacy rights, and GST compliance. BCI warned that incorrect interpretations of landmark judgments, including the Citizenship Amendment Act (CAA) and the Right to Privacy ruling, have led to confusion and misguidance, contributing to unnecessary judicial burdens.

BCI's Directives on Legal Advertising and Social Media

The BCI has mandated immediate action against unethical advertising and legal advice dissemination:

  • Prohibition on using Bollywood actors, celebrities, or influencers for promoting legal services.
  • Swift removal of banners, promotional materials, and digital advertisements related to legal practices.
  • Mandatory cessation of misleading legal advice by non-enrolled individuals.
  • Absolute ban on soliciting legal work via social media or digital platforms.
  • Vetting mechanisms for legal content on digital platforms to ensure accuracy and compliance with ethical standards.

Legal Consequences for Violation

The BCI has warned that any violation of these mandates will lead to serious consequences, including suspension or cancellation of the advocate's enrollment. Furthermore, the Council will refer violators for contempt proceedings before the Supreme Court and formally file complaints with digital platforms for removing unethical content.

Recent Controversy and Legal Precedents

The BCI’s stance comes after DSK Legal faced controversy for sharing a Instagram reel featuring a Bollywood actor endorsing their legal services. The BCI has previously referred to a Madras High Court judgment which categorically stated that online promotional activities violate the Advocates Act, 1961 and the BCI Rules, and no digital platform can claim protection under Section 79 of the Information Technology Act, 2000 for facilitating such practices.

Implications for Online Legal Platforms

Following the Supreme Court’s judgment in A. K. Balaji v. Union of India (2018), the BCI reiterated that online platforms facilitating legal services, including companies like Quikr India, Sulekha, Just Dial, and Grotal.com, must comply with the Advocates Act, 1961. The BCI asserted its broad regulatory authority over any entity involved in the practice of law, emphasizing that these platforms must adhere to the Council's rules and guidelines.
