In a significant ruling reinforcing accountability of law enforcement, the Allahabad High Court has directed the Uttar Pradesh government to pay ₹50,000 compensation to an accused who was kept in jail for 15 additional days due to a police error.

The order was passed by Justice Arun Kumar Singh Deshwal while hearing the bail plea of an accused named Furkan, who had been arrested in a car theft case.

The Court observed that even though there was no mala fide intent, the prolonged detention was a result of negligence on the part of the investigating officer, which led to a violation of the accused’s personal liberty.


Background of the Case

The accused was arrested in November of the previous year and had become eligible for bail on February 23. However, his release was delayed, and he remained in custody for 15 extra days.

The delay occurred because the police incorrectly reported his criminal history, claiming that he was involved in 12 cases instead of the actual five cases.

This incorrect information was placed before the Court to oppose his bail, which ultimately resulted in his continued incarceration.


Court’s Observations

The High Court took serious note of the error and held that:

  • The accused suffered unjustified deprivation of liberty due to incorrect police records
  • The mistake, though not intentional, amounted to negligence
  • Such lapses cannot be ignored as they directly affect fundamental rights under Article 21

The Court stated that the State is responsible for ensuring accurate investigation and reporting, and any failure in this regard must attract consequences.


Directions issued by the Court

While granting bail to the accused on March 10, the Court:

  • Directed the State government to pay ₹50,000 compensation within one month
  • Noted that the compensation may be recovered from the erring officials, if deemed appropriate
  • Summoned senior police officials to explain the lapse during proceedings

The Court also examined the role of digital systems such as:

  • Crime and Criminal Tracking Network and Systems (CCTNS)
  • Inter-operable Criminal Justice System (ICJS)

It was revealed that although such systems could have prevented the error, they were not effectively used due to shortage of staff.


Systemic concerns flagged

The High Court expressed concern over:

  • Non-utilisation of technological tools meant to ensure accuracy
  • Administrative lapses within the prosecution machinery
  • The need for adequate staffing and proper verification mechanisms

Accordingly, the Court directed authorities to ensure that sufficient staff is deployed so that such errors do not recur.


Significance of the Judgment

This ruling underscores that:

  • Personal liberty cannot be compromised due to administrative negligence
  • The State is liable for errors committed by its officials
  • Courts will grant monetary compensation for unlawful or prolonged detention

It also reinforces the principle that even unintentional mistakes by authorities can have serious constitutional consequences, warranting judicial intervention.


इलाहाबाद हाईकोर्ट का आदेश: पुलिस की गलती से 15 दिन अधिक जेल में रहने पर आरोपी को ₹50,000 मुआवजा

Allahabad High Court ने एक महत्वपूर्ण फैसले में उत्तर प्रदेश सरकार को ₹50,000 का मुआवजा देने का निर्देश दिया, क्योंकि एक आरोपी को पुलिस की गलती के कारण 15 दिन अधिक जेल में रहना पड़ा।

यह आदेश Justice Arun Kumar Singh Deshwal ने आरोपी फुरकान की जमानत याचिका पर सुनवाई करते हुए पारित किया।

अदालत ने माना कि यह मामला पुलिस की लापरवाही (negligence) का परिणाम है, जिससे आरोपी की व्यक्तिगत स्वतंत्रता का हनन हुआ।


मामले की पृष्ठभूमि

आरोपी को नवंबर में गिरफ्तार किया गया था और वह 23 फरवरी को जमानत का हकदार हो गया था, लेकिन वह 15 दिन अतिरिक्त जेल में रहा।

इसका कारण यह था कि पुलिस ने अदालत के समक्ष उसकी आपराधिक पृष्ठभूमि गलत तरीके से प्रस्तुत की:

  • वास्तविक मामले: 5
  • पुलिस द्वारा बताए गए मामले: 12

इस गलत जानकारी के आधार पर उसकी जमानत में देरी हुई।


अदालत की टिप्पणी

हाईकोर्ट ने कहा कि:

  • आरोपी की व्यक्तिगत स्वतंत्रता (Article 21) का उल्लंघन हुआ है
  • पुलिस की गलती भले ही जानबूझकर न हो, लेकिन यह गंभीर लापरवाही है
  • ऐसी त्रुटियों के लिए राज्य को जिम्मेदार ठहराया जाएगा

अदालत के निर्देश

अदालत ने:

  • राज्य सरकार को ₹50,000 मुआवजा देने का आदेश दिया
  • भविष्य में ऐसी घटनाओं को रोकने के लिए प्रणालीगत सुधार के निर्देश दिए
  • संबंधित अधिकारियों की जिम्मेदारी तय करने की बात कही

प्रणालीगत खामियां

सुनवाई के दौरान यह सामने आया कि:

  • CCTNS और ICJS जैसी तकनीक उपलब्ध होने के बावजूद उनका सही उपयोग नहीं हुआ
  • स्टाफ की कमी के कारण डेटा सत्यापन में त्रुटि हुई

अदालत ने निर्देश दिया कि भविष्य में ऐसी गलतियों से बचने के लिए पर्याप्त स्टाफ और तकनीकी उपयोग सुनिश्चित किया जाए।
