Advocates Act Set for Amendment: A New Era for General Counsel in India

Arjun Meghwal Confirms Amendments to the Advocates Act, 1961
Arjun Ram Meghwal, Union Minister of State for Law and Justice, recently announced that the Advocates Act, 1961, will soon undergo an amendment. His remarks, made during the General Counsels' Association India (GCAI) event on January 31, 2025, hinted that the changes would likely be advantageous for General Counsels (GCs). The event focused on providing statutory recognition to GCs, aligning their status more closely with practising advocates under the existing law.

GCs to Receive Statutory Recognition
General Counsels, who serve as the primary legal officers within companies and organizations, are often responsible for ensuring legal compliance, advising management, and overseeing the organization's legal interests. Despite their growing significance in the corporate sector, GCs have long lacked statutory recognition in India’s legal framework. The proposed amendment to the Advocates Act aims to address this gap, officially recognizing GCs as integral players in the country’s legal profession.

Meghwal’s Encouraging Remarks to GCs
During an interactive session at the event, Meghwal engaged directly with GCs, asking for a SWOT (Strength, Weakness, Opportunity, Threat) analysis of their profession. GCs unanimously pointed to the lack of statutory recognition as their primary weakness. In response, Meghwal assured them that significant opportunities were on the horizon.

“You have many strengths, one weakness, and multiple opportunities,” he noted, further stressing the critical role GCs play in contributing to the nation’s GDP. He added, “I asked my bureaucrats if it will be detrimental if GCs are statutorily recognized. They had no answer.”

Support for Statutory Recognition Grows Among Legal Leaders
Dr. Lalit Bhasin, President of the Society of Indian Law Firms (SILF), expressed strong support for GCs seeking statutory recognition. He suggested that GCs could file a writ petition to assert their legal standing but encouraged them to explore administrative avenues first. Bhasin emphasized that GCs' contributions are integral to India’s legal system, where the public service element is key.

Judicial Endorsement for GCs
Retired Supreme Court Judges, Justices AK Sikri and Hima Kohli, who were guests of honor at the event, also spoke in favour of GCs. Justice (retired) Sikri highlighted the growing significance of GCs in India’s free-market environment, praising their deep knowledge of the country’s regulatory framework. Justice Kohli further acknowledged how GCs are critical enablers in an increasingly complex legal landscape, especially as technologies like Generative AI disrupt traditional legal practices.

“Our legal ecosystem must now navigate opportunities while addressing challenges of digital transformation,” she said.

The Path Forward for General Counsel
As India’s legal ecosystem adapts to rapid changes, including advancements in technology and regulation, GCs remain at the forefront of this transformation. The call for their statutory recognition represents a significant shift, acknowledging their pivotal role in guiding organizations through legal challenges and opportunities.
