In a significant development concerning alleged hate-crime prosecution, the Supreme Court of India has been informed that the Uttar Pradesh Government will add hate-crime provisions under Sections 153B and 295A of the Indian Penal Code (IPC) in connection with the alleged attack on a Noida-based Muslim cleric, Kazeem Ahmad Sherwani.

The assurance came after critical observations by a Bench of Justices Vikram Nath and Sandeep Mehta, which questioned why relevant hate-crime provisions had not initially been invoked in the FIR despite allegations indicating religiously motivated violence.

Background Of The Incident

The case relates to an alleged incident in July 2021, where the cleric claimed he was attacked by a group of individuals because of his religious identity. He alleged verbal abuse, humiliation, and physical assault linked to his Muslim identity.

According to the petitioner:

  • He was allegedly offered a ride while travelling but was later abused.
  • His beard was reportedly pulled and he was humiliated.
  • The attack was claimed to be motivated by religious identity.

Police Investigation And FIR Controversy

Despite the alleged hate-crime nature of the incident:

  • Police initially declined to register an FIR.
  • An FIR was eventually registered in January 2023, but only under general criminal provisions such as hurt and intimidation.
  • Hate-crime provisions like Sections 153B and 295A IPC were not invoked.

This omission led the petitioner to approach the Supreme Court seeking:

  • A fair investigation.
  • Action against police officials for alleged inaction.

Supreme Court Observations

During hearings:

  • The Court noted that the Investigating Officer committed a “grave error” by not invoking appropriate hate-crime provisions earlier.
  • Authorities were allowed time to rectify the lapse through further investigation.

The Additional Solicitor General K.M. Nataraj informed the Court that:

  • Ingredients of Sections 153B and 295A IPC were made out on the allegations.
  • Since the chargesheet was already filed, investigators would seek permission from the trial court to add these provisions.

Legal Significance Of IPC Sections Involved

Section 153B IPC: Deals with imputations prejudicial to national integration and promotion of enmity between groups.

Section 295A IPC: Covers deliberate acts intended to outrage religious feelings by insulting religion or religious beliefs.

Invocation of these sections indicates recognition of possible hate-crime elements rather than ordinary criminal assault.


Current Status Of The Case

  • The investigation agency is expected to move the trial court to include the additional hate-crime offences.
  • Mandatory sanction under criminal procedure law will also be sought before further investigation proceeds.
  • The Supreme Court has kept the matter pending while broader hate-speech petitions are also under consideration.

कथित हेट-क्राइम मामले में एक महत्वपूर्ण घटनाक्रम में सुप्रीम कोर्ट को बताया गया कि उत्तर प्रदेश सरकार नोएडा के मुस्लिम मौलवी काज़िम अहमद शेरवानी पर हुए कथित हमले के मामले में IPC की धारा 153B और 295A जोड़कर हेट-क्राइम की जांच करेगी।

यह जानकारी न्यायमूर्ति विक्रम नाथ और न्यायमूर्ति संदीप मेहता की पीठ के समक्ष दी गई, जिसने पहले सवाल उठाया था कि धार्मिक पहचान से जुड़े आरोपों के बावजूद FIR में हेट-क्राइम धाराएं क्यों नहीं जोड़ी गईं।

घटना की पृष्ठभूमि

मामला जुलाई 2021 की घटना से जुड़ा है, जिसमें मौलवी ने आरोप लगाया कि:

  • उन्हें धार्मिक पहचान के कारण निशाना बनाया गया।
  • कथित रूप से गाली-गलौज, अपमान और शारीरिक हमला हुआ।
  • उनकी दाढ़ी खींची गई और धार्मिक आधार पर अपमानित किया गया।

FIR और पुलिस कार्रवाई विवाद

पीड़ित के अनुसार:

  • शुरू में पुलिस ने FIR दर्ज नहीं की।
  • जनवरी 2023 में FIR दर्ज हुई, परंतु केवल सामान्य आपराधिक धाराओं में।
  • हेट-क्राइम से जुड़ी धाराएं शामिल नहीं की गईं।

इस पर पीड़ित ने सुप्रीम कोर्ट में निष्पक्ष जांच और पुलिस अधिकारियों के खिलाफ कार्रवाई की मांग की।

सुप्रीम कोर्ट की टिप्पणियां

सुनवाई के दौरान:

  • अदालत ने कहा कि उचित धाराएं न लगाना “गंभीर त्रुटि” थी।
  • जांच एजेंसी को त्रुटि सुधारने का अवसर दिया गया।

एडिशनल सॉलिसिटर जनरल के.एम. नटराज ने अदालत को बताया कि:

  • आरोपों में IPC की धारा 153B व 295A लागू हो सकती हैं।
  • ट्रायल कोर्ट से अनुमति लेकर आगे जांच की जाएगी।

संबंधित कानूनी धाराएं

धारा 153B IPC: राष्ट्रीय एकता के खिलाफ बयान या समूहों में वैमनस्य फैलाने से संबंधित।

धारा 295A IPC: किसी धर्म या धार्मिक भावनाओं को ठेस पहुंचाने वाले जानबूझकर किए गए कृत्यों से संबंधित।


वर्तमान स्थिति

  • ट्रायल कोर्ट से अनुमति लेकर नई धाराएं जोड़ने की प्रक्रिया शुरू होगी।
  • अनिवार्य सरकारी स्वीकृति (sanction) भी ली जाएगी।
  • मामला सुप्रीम कोर्ट में लंबित है और आगे सुनवाई जारी रहेगी।
