Decision Taken at Full-Court Meeting

The decision was reached during a full-court meeting held on April 1, where it was resolved that judges would disclose their asset details to the Chief Justice of India (CJI). These declarations will subsequently be made accessible to the public via the official website of the Supreme Court.

According to sources, while all judges have already submitted their asset disclosures, the mechanism and format for publication are currently being worked out and will be finalized in due course.

Context: Growing Demand for Judicial Transparency

The move comes in the wake of heightened public scrutiny regarding judicial accountability, particularly after allegations surfaced about the discovery of unaccounted cash at the official residence of Justice Yashwant Varma during his tenure as a judge of the Delhi High Court. Though unrelated to the current resolution, the controversy is believed to have intensified internal deliberations on the need for systemic transparency.

First Collective Step Toward Public Disclosure

This is the first time that the entire Supreme Court bench has agreed to publicly release their asset declarations. Historically, judges have submitted such disclosures confidentially to the CJI, but there was no protocol for making them publicly accessible. The present decision is seen as a milestone in efforts to institutionalize openness in the functioning of the higher judiciary.

Legal Community Welcomes the Initiative

The move has been widely welcomed by members of the legal fraternity and civil society organizations. Transparency advocates have described it as a progressive and necessary step to strengthen the judiciary’s credibility. It also aligns the judiciary with other constitutional offices where asset disclosures are mandatory and publicly accessible.

Next Steps and Implementation

The Supreme Court is expected to issue guidelines outlining the format, frequency, and platform for publication. The public disclosure is likely to include movable and immovable assets, liabilities, and financial interests, similar to declarations required of elected representatives.

This development may also serve as a model for High Courts and subordinate courts across the country, potentially paving the way for a more comprehensive framework on judicial accountability.
