Supreme Court grants Anticipatory Bail to Singer Neha Rathore in Pahalgam Post Case

The Supreme Court of India has made interim protection from arrest granted to Bhojpuri folk singer Neha Singh Rathore absolute in connection with an FIR registered over her alleged objectionable social media posts regarding Prime Minister Narendra Modi and the Pahalgam terror attack.

The order was passed by a Bench of Justice J.K. Maheshwari and Justice Atul S. Chandurkar, which directed that no coercive steps be taken against Rathore while the criminal proceedings continue.

यह मामला उनके सोशल मीडिया पोस्ट से जुड़ा है, जिसमें उन्होंने कथित रूप से प्रधानमंत्री नरेंद्र मोदी और पहलगाम आतंकवादी हमले को लेकर टिप्पणी की थी।

यह आदेश न्यायमूर्ति जे.के. माहेश्वरी और न्यायमूर्ति अतुल एस. चंदुरकर की पीठ ने पारित किया।

इससे पहले इलाहाबाद हाईकोर्ट की लखनऊ पीठ ने एफआईआर रद्द करने से इनकार करते हुए अग्रिम जमानत देने से भी मना कर दिया था।

हाईकोर्ट ने कहा कि शिकायत में प्रथम दृष्टया संज्ञेय अपराध का खुलासा होता है, इसलिए पुलिस जांच आवश्यक है।

सुप्रीम कोर्ट में अपील

इसके बाद राठौर ने सुप्रीम कोर्ट में याचिका दायर कर गिरफ्तारी से संरक्षण की मांग की।

उनके वकील ने तर्क दिया कि:

• एफआईआर में लगाए गए आरोप अत्यधिक और अनुपातहीन हैं
• उनके पोस्ट संविधान के अनुच्छेद 19(1)(a) के तहत अभिव्यक्ति की स्वतंत्रता के दायरे में आते हैं।

सुप्रीम कोर्ट का आदेश

सुप्रीम कोर्ट ने सुनवाई के बाद राठौर को गिरफ्तारी से अंतरिम संरक्षण प्रदान किया और कहा कि उनके खिलाफ कोई दमनात्मक कार्रवाई नहीं की जाएगी।

अदालत ने उन्हें निर्देश दिया कि:

• वे जांच में सहयोग करें
