In a significant development, the Supreme Court Collegium has proposed the elevation of Justice Joymalya Bagchi from the Calcutta High Court to the Supreme Court. This move comes as part of the Collegium's ongoing efforts to ensure a diverse and balanced representation within the highest judicial body in the country.
A Historic Gap in Representation
One of the key factors influencing the proposal is the fact that since the retirement of Mr. Justice Altamas Kabir on 18th July 2013 as the Chief Justice of India (CJI), there has not been any CJI from the Calcutta High Court. This gap has been a notable absence in terms of representation from the Calcutta High Court, which the Collegium aims to address with this elevation.
Future Prospects for Justice Joymalya Bagchi
Justice Bagchi is slated to play a crucial role in the future of the judiciary. Upon the retirement of Mr. Justice K.V. Viswanathan on 25th May 2031, Justice Joymalya Bagchi would be in line to assume the esteemed position of Chief Justice of India. He would then serve as the CJI until his retirement on 2nd October 2031, providing him with a significant tenure of more than six years.
Current Representation in the Supreme Court
Currently, the Supreme Court Bench is represented by only one judge from the Calcutta High Court, highlighting the need for greater diversity. Justice Joymalya Bagchi, who ranks at Sl. No. 11 in the combined all-India seniority list of High Court Judges (including Chief Justices), stands as an excellent candidate for this elevation.
The Supreme Court Collegium's proposal underscores the importance of a balanced representation of regional High Courts at the highest levels of India's judiciary.
