In a significant policy decision aimed at improving administrative continuity in India’s High Courts, the Supreme Court Collegium has adopted a new policy to ensure that judges proposed to be appointed as Chief Justices of High Courts are made available well in advance of the retirement of incumbent Chief Justices. This announcement was made following the Collegium’s meeting held on February 26, 2026.

Under the new policy, the Collegium — the constitutional body responsible for judicial appointments and transfers — has decided that a judge recommended for appointment as Chief Justice of a High Court may be transferred to that High Court preferably at least two months before the vacancy is expected to arise due to retirement. The objective is to allow the incoming Chief Justice sufficient time to become fully familiar with the judicial, administrative, and institutional dynamics of the court, thereby enabling a seamless transition upon assuming charge.

The statement issued by the Collegium emphasised that such advance transfers will help strengthen the efficiency and quality of the administration of justice. It noted that familiarising the incoming Chief Justice with the workings of the High Court will allow the judge to take over the office of Chief Justice immediately upon the retirement of the incumbent without any leadership vacuum.

This policy shift is expected to address a long-standing concern regarding frequent leadership changes and transitional gaps in High Courts, particularly given the requirement under the Memorandum of Procedure (MoP) that Chief Justices are often selected from outside the parent High Court. By enabling prior transfer, the Collegium aims to preserve institutional independence, minimise disruptions, and bolster public confidence in the impartial administration of justice.

In line with this new policy, the Collegium has already taken steps to recommend the transfer and appointment of judges in advance of anticipated retirements, including recommending Justice Lisa Gill of the Punjab and Haryana High Court to the Andhra Pradesh High Court, subject to the approval of the Union Government.

 

The initiative reflects a broader judicial administrative reform trend focused on enhancing leadership continuity in High Courts across India.
