Srinagar Court Issues Non-Bailable Warrant Against Farooq Abdullah in JKCA Misappropriation Case

A court in Srinagar has issued a non-bailable warrant (NBW) against senior political leader Farooq Abdullah in connection with the alleged financial misappropriation case involving the Jammu and Kashmir Cricket Association (JKCA).

The order was passed by the Chief Judicial Magistrate (CJM), Srinagar, after rejecting Abdullah’s plea seeking exemption from personal appearance during the hearing in the case.

Court’s observation on non-appearance

The court noted that Abdullah had been provided the option to appear virtually through video conferencing, but he failed to ensure his presence before the court on the scheduled date. Consequently, the court proceeded to issue a non-bailable warrant against him.

The hearing was scheduled for the framing of charges in the case against Abdullah and other accused persons.

Background of the JKCA scam case

The case relates to alleged financial irregularities and misappropriation of funds within the Jammu and Kashmir Cricket Association during Abdullah’s tenure as its president.

The Central Bureau of Investigation (CBI) is probing the case and had earlier filed a chargesheet in 2018 against several accused, including Abdullah.

According to the investigation, funds meant for the development of cricket in Jammu and Kashmir were allegedly misappropriated. Reports indicate that over ₹43 crore out of funds allocated to the cricket body may have been siphoned off between 2002 and 2011.

Developments surrounding the hearing

During the hearing, Abdullah was reportedly in Jammu, where he had survived a security scare involving a firearm incident at a wedding event a day earlier. His counsel sought exemption from appearance citing these circumstances.

However, the court rejected the exemption request and issued the warrant.

Some reports later indicated that the court subsequently recalled the non-bailable warrant after hearing the defence plea, taking into account the circumstances explained by Abdullah’s counsel.

Significance of the case

The JKCA case is considered one of the major corruption investigations linked to sports administration in Jammu and Kashmir. The proceedings are part of a long-running probe into alleged financial misconduct in the cricket body’s functioning.

The matter will now continue before the Srinagar court as it moves toward the framing of charges and further trial proceedings.


जेकेसीए गबन मामले में फारूक अब्दुल्ला के खिलाफ गैर-जमानती वारंट जारी

श्रीनगर की एक अदालत ने Farooq Abdullah के खिलाफ गैर-जमानती वारंट (NBW) जारी किया है। यह आदेश Jammu and Kashmir Cricket Association (JKCA) में कथित वित्तीय गबन के मामले में पारित किया गया।

यह आदेश मुख्य न्यायिक मजिस्ट्रेट (CJM), श्रीनगर की अदालत ने उस समय दिया जब अब्दुल्ला की ओर से दायर व्यक्तिगत उपस्थिति से छूट की याचिका को खारिज कर दिया गया।

अदालत की टिप्पणी

अदालत ने कहा कि अब्दुल्ला को वीडियो कॉन्फ्रेंसिंग के माध्यम से उपस्थित होने का विकल्प भी दिया गया था, लेकिन उन्होंने निर्धारित तारीख पर अपनी उपस्थिति सुनिश्चित नहीं की। इस कारण अदालत ने उनके खिलाफ गैर-जमानती वारंट जारी कर दिया।

यह सुनवाई मामले में आरोप तय करने (framing of charges) के लिए निर्धारित की गई थी।

जेकेसीए घोटाले की पृष्ठभूमि

यह मामला जम्मू-कश्मीर क्रिकेट एसोसिएशन में कथित वित्तीय अनियमितताओं और गबन से जुड़ा है, जो उस समय हुआ जब फारूक अब्दुल्ला इस संस्था के अध्यक्ष थे।

इस मामले की जांच Central Bureau of Investigation (CBI) कर रही है। सीबीआई ने 2018 में आरोपपत्र दाखिल किया था, जिसमें अब्दुल्ला सहित कई अन्य लोगों को आरोपी बनाया गया।

जांच एजेंसी के अनुसार जम्मू-कश्मीर में क्रिकेट के विकास के लिए आवंटित धन का दुरुपयोग किया गया। रिपोर्टों के अनुसार लगभग ₹43 करोड़ की राशि 2002 से 2011 के बीच कथित रूप से गबन की गई।

सुनवाई से जुड़ी परिस्थितियां

सुनवाई के समय फारूक अब्दुल्ला जम्मू में थे, जहां एक दिन पहले एक हथियार से जुड़े सुरक्षा घटनाक्रम से वह बाल-बाल बच गए थे। उनके वकील ने इसी आधार पर अदालत से उपस्थिति से छूट की मांग की।

हालांकि अदालत ने इस याचिका को खारिज करते हुए वारंट जारी कर दिया।

बाद में कुछ रिपोर्टों में बताया गया कि अदालत ने बचाव पक्ष की दलीलें सुनने के बाद वारंट वापस भी ले लिया, क्योंकि परिस्थितियों को ध्यान में रखा गया।

मामले का महत्व

जेकेसीए मामला जम्मू-कश्मीर में खेल प्रशासन से जुड़े सबसे चर्चित वित्तीय मामलों में से एक माना जाता है।

यह मामला अभी भी न्यायालय में लंबित है और आगे आरोप तय होने तथा ट्रायल की प्रक्रिया जारी रहेगी।
