In a significant ruling on the scope of constitutional remedies, the Madras High Court has held that a habeas corpus petition cannot be invoked when a wife voluntarily leaves her matrimonial home to live with another man, as such a situation does not constitute illegal detention.

The judgment was delivered by a Division Bench of the High Court while dismissing a habeas corpus petition filed by a husband seeking the production of his wife.


Facts of the Case

The petitioner-husband approached the Court alleging that his wife had been illegally detained by another man after she left their matrimonial home. He sought directions for her production before the Court and for her custody to be restored to him.

However, during the proceedings, it emerged that the woman was an adult and had left her home of her own free will. She expressed her desire to continue living with the person she had chosen.


Court’s Observations

The Court made it clear that the writ of habeas corpus is a remedy available only in cases of unlawful or illegal detention. It cannot be used to resolve disputes arising out of matrimonial discord.

The Bench observed that when an adult woman exercises her free will to reside with a person of her choice, such an act cannot be construed as confinement or detention.

The Court further emphasized that personal liberty includes the right to choose one’s partner and place of residence, and such choices cannot be interfered with through writ jurisdiction.


Not a Remedy for Matrimonial Disputes

The High Court clarified that the petitioner’s grievance stemmed from a marital dispute, and therefore, the appropriate remedies lie under family law, such as:

  • Divorce proceedings
  • Restitution of conjugal rights
  • Judicial separation

The Court cautioned against the misuse of habeas corpus petitions in personal disputes, noting that such practice would dilute the constitutional significance of the remedy.


Decision of the Court

In light of the above findings, the High Court:

  • Dismissed the habeas corpus petition
  • Held that no case of illegal detention was made out
  • Declined to grant any relief to the petitioner

Significance of the Judgment

This ruling reinforces a well-settled legal principle that:

  • Habeas corpus is not a tool for resolving matrimonial conflicts
  • Courts must respect the autonomy and dignity of adult individuals
  • Constitutional remedies cannot be invoked to control personal relationships

The judgment underscores the judiciary’s consistent stance in protecting individual liberty and choice, especially in matters involving adult relationships.

मद्रास हाईकोर्ट ने एक महत्वपूर्ण निर्णय में स्पष्ट किया है कि यदि कोई पत्नी स्वेच्छा से अपने पति का घर छोड़कर किसी अन्य व्यक्ति के साथ रहने का निर्णय लेती है, तो ऐसी स्थिति में हैबियस कॉर्पस याचिका दायर नहीं की जा सकती, क्योंकि यह अवैध हिरासत का मामला नहीं बनता।

यह फैसला हाईकोर्ट की खंडपीठ ने उस याचिका पर सुनवाई करते हुए दिया, जिसमें एक पति ने अपनी पत्नी को पेश कराने की मांग की थी।


मामले के तथ्य

याचिकाकर्ता पति ने आरोप लगाया कि उसकी पत्नी को एक अन्य व्यक्ति ने अवैध रूप से हिरासत में रखा हुआ है और उसे अदालत के समक्ष प्रस्तुत किया जाए।

लेकिन सुनवाई के दौरान यह स्पष्ट हुआ कि:

  • पत्नी वयस्क है
  • उसने अपनी इच्छा से घर छोड़ा
  • वह अपनी पसंद के व्यक्ति के साथ रहना चाहती है

अदालत की टिप्पणी

अदालत ने कहा कि हैबियस कॉर्पस केवल अवैध हिरासत के मामलों में लागू होता है।

यदि कोई वयस्क महिला अपनी इच्छा से किसी के साथ जाती है, तो उसे अवैध हिरासत नहीं माना जा सकता।

अदालत ने यह भी कहा कि व्यक्तिगत स्वतंत्रता में यह अधिकार शामिल है कि कोई व्यक्ति अपनी पसंद के व्यक्ति के साथ रहने का निर्णय ले सके।


वैवाहिक विवाद के लिए अलग उपाय

हाईकोर्ट ने स्पष्ट किया कि यह मामला वैवाहिक विवाद का है और इसके लिए पति को निम्न उपाय अपनाने चाहिए:

  • तलाक
  • वैवाहिक अधिकारों की पुनर्स्थापना
  • न्यायिक पृथक्करण

अदालत ने यह भी चेतावनी दी कि हैबियस कॉर्पस का उपयोग इस प्रकार के मामलों में करना संवैधानिक उपाय का दुरुपयोग है।


अंतिम निर्णय

अदालत ने:

  • याचिका को खारिज कर दिया
  • कहा कि यह अवैध हिरासत का मामला नहीं है
  • याचिकाकर्ता को कोई राहत देने से इनकार किया
