A Delhi court has rejected the bail plea of Shahrukh Pathan, the man accused of pointing a gun at a police officer during the 2020 North-East Delhi riots. The order was passed by the Karkardooma Court while hearing his application for regular bail.

The case relates to a widely circulated incident during the riots where Pathan was allegedly photographed brandishing a pistol and aiming it at a police constable, an image that later went viral on social media.

Court’s reasoning for rejecting bail

The bail plea was dismissed by Additional Sessions Judge Sameer Bajpai. The court noted that the Delhi High Court had already denied bail to Pathan in October 2024, and there had been no substantial change in circumstances that would justify granting bail now.

The judge observed that merely the passage of time since the earlier bail rejection could not be considered a sufficient ground to grant bail.

Background of the case

Shahrukh Pathan was arrested in March 2020 following the registration of FIR No. 51/2020 at Jafrabad Police Station in connection with violence during the Delhi riots.

He faces several serious charges, including:

  • Attempt to murder (Section 307 IPC)
  • Rioting and unlawful assembly
  • Obstructing a public servant from performing duty
  • Offences under the Arms Act

Prosecutors alleged that Pathan was part of a violent mob during clashes in the Jafrabad–Maujpur area on February 24, 2020, when riots erupted in several parts of North-East Delhi.

Defence arguments

During the hearing, the defence argued that Pathan had already spent more than five years in judicial custody since his arrest in March 2020. It was also submitted that the maximum punishment for the offence under Section 307 IPC can extend up to ten years, and he had already undergone more than half of that period as an undertrial.

The defence also pointed out that the trial is progressing slowly, as the prosecution has cited around 100 witnesses, of whom only a few have been examined so far.

Prosecution’s stance

The prosecution opposed the bail application, emphasising the seriousness of the allegations and the evidence against the accused, including photographs and video footage showing Pathan pointing a firearm at a police officer during the riots.

Significance of the case

The incident became one of the most widely reported visuals from the 2020 Delhi riots, symbolising the scale of violence during the clashes. The riots broke out in February 2020 amid tensions surrounding the Citizenship Amendment Act (CAA) and resulted in over 50 deaths and hundreds of injuries.

The trial in the case is currently ongoing, with evidence being recorded before the trial court.

दिल्ली की एक अदालत ने 2020 उत्तर-पूर्वी दिल्ली दंगों के दौरान पुलिसकर्मी पर बंदूक तानने के आरोपी शाहरुख पठान की जमानत याचिका खारिज कर दी है। यह आदेश कड़कड़डूमा अदालत द्वारा पारित किया गया।

यह मामला उस घटना से संबंधित है जिसमें दंगों के दौरान शाहरुख पठान की एक तस्वीर सामने आई थी, जिसमें वह एक पुलिस कांस्टेबल पर पिस्तौल तानते हुए दिखाई दे रहे थे। यह तस्वीर सोशल मीडिया पर व्यापक रूप से वायरल हुई थी।

अदालत का तर्क

Additional Sessions Judge Sameer Bajpai ने जमानत याचिका खारिज करते हुए कहा कि दिल्ली हाई कोर्ट पहले ही अक्टूबर 2024 में आरोपी की जमानत याचिका खारिज कर चुका है, और उसके बाद से परिस्थितियों में कोई महत्वपूर्ण बदलाव नहीं हुआ है।

अदालत ने कहा कि केवल समय बीत जाने को जमानत देने का आधार नहीं माना जा सकता।

मामले की पृष्ठभूमि

शाहरुख पठान को मार्च 2020 में गिरफ्तार किया गया था। यह मामला जाफराबाद पुलिस स्टेशन में दर्ज FIR संख्या 51/2020 से संबंधित है।

उनके खिलाफ कई गंभीर आरोप लगाए गए हैं, जिनमें शामिल हैं:

  • हत्या के प्रयास (IPC धारा 307)
  • दंगा और अवैध जमावड़ा
  • सरकारी कर्मचारी को ड्यूटी करने से रोकना
  • आर्म्स एक्ट के तहत अपराध

अभियोजन के अनुसार, 24 फरवरी 2020 को जाफराबाद-मौजपुर क्षेत्र में हुई हिंसा के दौरान वह एक हिंसक भीड़ का हिस्सा था।

बचाव पक्ष की दलील

बचाव पक्ष ने अदालत को बताया कि शाहरुख पठान मार्च 2020 से लगातार न्यायिक हिरासत में हैं, यानी वह लगभग पांच वर्षों से जेल में हैं।

यह भी तर्क दिया गया कि IPC की धारा 307 के तहत अधिकतम सजा 10 वर्ष तक हो सकती है, और आरोपी पहले ही इसका आधे से अधिक समय जेल में बिता चुका है।

साथ ही यह भी कहा गया कि मामले में लगभग 100 गवाह हैं, जिनमें से अभी तक केवल कुछ ही की गवाही हुई है, इसलिए मुकदमे के समाप्त होने में अभी काफी समय लग सकता है।

अभियोजन पक्ष का रुख

अभियोजन पक्ष ने जमानत का विरोध करते हुए कहा कि आरोपी के खिलाफ गंभीर आरोप और पर्याप्त साक्ष्य मौजूद हैं, जिनमें तस्वीरें और वीडियो शामिल हैं जिनमें वह पुलिसकर्मी पर बंदूक तानते हुए दिखाई देता है।

मामले का महत्व

यह घटना 2020 दिल्ली दंगों की सबसे चर्चित तस्वीरों में से एक बन गई थी। फरवरी 2020 में हुए इन दंगों में 50 से अधिक लोगों की मौत और सैकड़ों लोग घायल हुए थे।

वर्तमान में इस मामले का मुकदमा जारी है और अदालत में साक्ष्य दर्ज किए जा रहे हैं।
