The Bombay High Court has dismissed a habeas corpus petition filed by former Mumbai police officer Sachin Waze, challenging his arrest in the Antilia bomb scare case. The petition was dismissed by a Bench of Justice Sarang Kotwal and Justice SM Modak.

Background of the Case

Waze was arrested by the National Investigation Agency (NIA) in March 2021 for his alleged involvement in the planting of an explosives-laden vehicle near industrialist Mukesh Ambani’s residence in Mumbai. The bomb scare case had attracted significant public attention.

Waze's Arguments in the Petition

In his petition, Waze argued that there were procedural violations in the extension of his remand. He also contended that his arrest was illegal, claiming that prior sanction from the Central Government was required for the arrest of a member of the armed forces engaged in maintaining public order, as stipulated by the State gogovernment.

In October 2024, the Bombay High Court had granted bail to Waze in a separate corruption case involving former Maharashtra home minister Anil Deshmukh, after the Central Bureau of Investigation (CBI) agreed to the grant of bail.
