In a significant development concerning the ongoing State Bar Council elections across India, the Supreme Court of India has directed its Registry not to entertain or list any petitions relating to Bar Council elections. The move aims to prevent parallel litigation that could disrupt the election process and to streamline resolution of disputes through a designated mechanism.

The direction was issued by a Bench led by Chief Justice of India Surya Kant along with Justices Joymalya Bagchi and Vipul M. Pancholi while dealing with petitions related to election disputes. The Court emphasised that multiple proceedings before different forums could delay elections and create administrative complications.

High-Powered Committee To Handle Election Disputes

The Supreme Court clarified that:

  • Aggrieved candidates or stakeholders must approach a High-Powered Election Supervisory Committee instead of filing fresh petitions in court.
  • This committee is headed by former Supreme Court judge Justice Sudhanshu Dhulia.
  • Other members include senior judicial and legal figures tasked with ensuring fair oversight of Bar Council elections.

The committee was constituted earlier by the Supreme Court to oversee Bar Council elections nationwide and ensure transparency and uniformity in the electoral process.

Background Of The Bar Council Elections Issue

The Supreme Court has been actively monitoring Bar Council elections because:

  • Elections in several State Bar Councils had been delayed for years.
  • Questions were raised about transparency, electoral fairness, and administrative functioning.

To address these concerns, the Court had previously:

  • Directed elections to be conducted under supervision of retired judges.
  • Set timelines for completing elections.
  • Introduced reforms such as electoral oversight mechanisms.

Purpose Of The Latest Supreme Court Direction

According to the Court’s observations:

  • Parallel petitions could disrupt election timelines.
  • Centralised grievance redressal through the supervisory committee would ensure consistency.
  • The aim is to facilitate smooth conduct of Bar Council elections without judicial delays.

Current Status

  • Fresh petitions regarding Bar Council elections will not be entertained by the Supreme Court Registry for the time being.
  • Election-related grievances must be routed through the Supreme Court-appointed supervisory committee.
  • The broader election process across State Bar Councils continues under judicial oversight.

बार काउंसिल चुनाव से संबंधित याचिकाओं पर सुप्रीम कोर्ट की रोक

देशभर में चल रहे स्टेट बार काउंसिल चुनावों से जुड़े एक महत्वपूर्ण घटनाक्रम में सुप्रीम कोर्ट ने अपने रजिस्ट्री को निर्देश दिया है कि बार काउंसिल चुनावों से संबंधित नई याचिकाएं स्वीकार या सूचीबद्ध न की जाएं। इस कदम का उद्देश्य चुनाव प्रक्रिया में बाधा डालने वाली समानांतर मुकदमेबाजी को रोकना और विवादों के समाधान के लिए एक केंद्रीकृत व्यवस्था सुनिश्चित करना है।

यह निर्देश मुख्य न्यायाधीश सूर्यकांत, न्यायमूर्ति जॉयमाल्या बागची और न्यायमूर्ति विपुल एम. पंचोली की पीठ ने दिया। अदालत ने कहा कि अलग-अलग मंचों पर लंबित याचिकाएं चुनाव प्रक्रिया में देरी और प्रशासनिक जटिलताएं पैदा कर सकती हैं।

हाई-पावर्ड कमेटी को सौंपी गई जिम्मेदारी

सुप्रीम कोर्ट ने स्पष्ट किया कि:

  • चुनाव से संबंधित शिकायतों के लिए सीधे अदालत जाने के बजाय सुप्रीम कोर्ट द्वारा गठित हाई-पावर्ड इलेक्शन सुपरवाइजरी कमेटी से संपर्क किया जाए।
  • इस समिति की अध्यक्षता पूर्व सुप्रीम कोर्ट न्यायाधीश न्यायमूर्ति सुधांशु धूलिया कर रहे हैं।
  • समिति का उद्देश्य चुनाव प्रक्रिया की निष्पक्ष निगरानी करना है।

बार काउंसिल चुनाव विवाद की पृष्ठभूमि

बार काउंसिल चुनावों को लेकर सुप्रीम कोर्ट पहले भी सक्रिय रहा है क्योंकि:

  • कई राज्यों में चुनाव लंबे समय से लंबित थे।
  • चुनाव प्रक्रिया की पारदर्शिता और निष्पक्षता पर सवाल उठे थे।

अदालत ने पूर्व में:

  • सेवानिवृत्त न्यायाधीशों की निगरानी में चुनाव कराने के निर्देश दिए।
  • समयसीमा तय की।
  • चुनाव सुधार संबंधी दिशानिर्देश जारी किए।

ताजा आदेश का उद्देश्य

सुप्रीम कोर्ट का कहना है कि:

  • समानांतर याचिकाएं चुनाव प्रक्रिया बाधित कर सकती हैं।
  • केंद्रीय समिति के माध्यम से शिकायत निपटान अधिक प्रभावी रहेगा।
  • इससे चुनाव समय पर और सुचारू रूप से हो सकेंगे।

वर्तमान स्थिति

  • फिलहाल बार काउंसिल चुनाव से जुड़ी नई याचिकाएं सुप्रीम कोर्ट में सूचीबद्ध नहीं होंगी।
  • सभी शिकायतें सुप्रीम कोर्ट द्वारा नियुक्त समिति के समक्ष ले जानी होंगी।
  • राज्य बार काउंसिल चुनाव न्यायिक निगरानी में जारी रहेंगे।
