The Supreme Court of India has granted anticipatory bail to former Telangana Special Intelligence Bureau (SIB) chief T. Prabhakar Rao, who is a key accused in the alleged illegal phone-tapping case that has triggered significant political and legal controversy in the State.

The order was passed by a Bench comprising Justice B.V. Nagarathna and Justice R. Mahadevan, which made absolute the interim protection from arrest that had earlier been granted to Rao during the proceedings.

The Court granted relief after the State informed the Bench that the investigation in the case was almost complete and that the accused had cooperated with the probe, while an additional chargesheet was expected to be filed.

Case Title

T. Prabhakar Rao v. State of Telangana

The case relates to an alleged illegal surveillance and phone-tapping operation carried out during the tenure of the previous Bharat Rashtra Samithi (BRS) government in Telangana.

Investigators have alleged that phones belonging to political leaders, businesspersons, journalists and even High Court judges were intercepted illegally as part of the operation.

The controversy emerged after a new government came to power in the State and a criminal investigation was launched into alleged misuse of intelligence resources for political surveillance.

During the hearing before the Supreme Court, the State government’s counsel submitted that the probe had progressed substantially and that custodial interrogation of the former intelligence chief was no longer necessary.

Taking note of these submissions and Rao’s cooperation with investigators, the Court decided to confirm the protection from arrest earlier granted to him, thereby granting anticipatory bail.

However, the Bench kept open the legal question regarding the maintainability of the anticipatory bail plea, indicating that the issue could still be examined in appropriate proceedings.

Background of the Phone Tapping Case

The Telangana phone-tapping controversy became one of the most high-profile political investigations in the State.

According to investigators, officials associated with the State’s intelligence wing allegedly used specialised surveillance systems to intercept calls and electronic communications of individuals without lawful authorization.

The investigation has reportedly examined allegations that the surveillance targeted political opponents, journalists, and other influential persons, raising concerns about the misuse of state machinery for political purposes.

Several police officers and intelligence officials have been questioned during the probe, and additional chargesheets are expected as the investigation progresses.

Significance of the Supreme Court Order

The Supreme Court’s decision is significant because it provides protection from arrest to one of the key accused in a politically sensitive surveillance scandal while the investigation continues.

Legal experts note that anticipatory bail is generally granted when courts are satisfied that custodial interrogation is unnecessary and the accused has cooperated with investigators.

The case continues to draw national attention due to its implications for privacy rights, political surveillance, and the lawful limits of intelligence-gathering powers in India.

सुप्रीम कोर्ट ने तेलंगाना के पूर्व स्पेशल इंटेलिजेंस ब्यूरो (SIB) प्रमुख टी. प्रभाकर राव को कथित फोन टैपिंग मामले में अग्रिम जमानत दे दी है।

यह आदेश न्यायमूर्ति बी.वी. नागरत्ना और न्यायमूर्ति आर. महादेवन की पीठ ने पारित किया, जिसने पहले दी गई अंतरिम गिरफ्तारी-रोधी सुरक्षा को स्थायी कर दिया।

सुनवाई के दौरान राज्य सरकार की ओर से अदालत को बताया गया कि मामले की जांच लगभग पूरी हो चुकी है और आरोपी ने जांच में सहयोग किया है, जबकि एक अतिरिक्त आरोप-पत्र जल्द दायर किया जा सकता है।

इन तथ्यों को ध्यान में रखते हुए सुप्रीम कोर्ट ने पहले दी गई गिरफ्तारी से सुरक्षा को कायम रखते हुए प्रभाकर राव को अग्रिम जमानत दे दी।

हालांकि अदालत ने यह भी स्पष्ट किया कि अग्रिम जमानत याचिका की स्वीकार्यता से जुड़ा कानूनी प्रश्न अभी खुला रहेगा, जिसे भविष्य में उपयुक्त मामले में देखा जा सकता है।

फैसले का महत्व

यह आदेश महत्वपूर्ण माना जा रहा है क्योंकि यह राजनीतिक रूप से संवेदनशील फोन टैपिंग मामले में प्रमुख आरोपी को गिरफ्तारी से सुरक्षा प्रदान करता है, जबकि जांच जारी है।
