Congress leader Rahul Gandhi has filed an application before the Special MP/MLA Court in Pune alleging concealment of material facts by complainant Satyaki Savarkar in the ongoing criminal defamation proceedings initiated against him.

The application, filed through Advocate Milind Pawar, contends that Satyaki Savarkar, who has claimed defamation over Gandhi's remarks concerning Vinayak Damodar Savarkar, failed to disclose a crucial maternal relationship with Nathuram Godse, the assassin of Mahatma Gandhi.

According to the application, Satyaki is the son of Ashok Savarkar, who is the nephew of Vinayak Savarkar. While this paternal lineage has been disclosed, Gandhi alleges that Satyaki's mother, Himani, is the daughter of Gopal Godse, the real brother of Nathuram Godse—both of whom were convicted for the assassination of Mahatma Gandhi.

Gandhi argues that the complainant suppressed this maternal link deliberately, thereby withholding a significant and material fact from the court. The application states: “As per information, his (Satyaki’s) mother Himani is originally and by birth from Godse family. Inspite of this, the complainant has deliberately, systematically and very brilliantly avoided and suppressed to disclose the family tree from his maternal side.”

Rahul Gandhi further claims that Satyaki only provided his paternal family tree with the complaint, while deliberately omitting the maternal side, thus concealing his direct blood relation with the Godse family.

Terming this as an attempt to mislead the court, Gandhi submits that such suppression of material fact amounts to fraud upon the court, which can warrant dismissal of the case or denial of relief. The application also recalls that Vinayak Savarkar himself was a co-accused in the Gandhi assassination case, though he was acquitted due to lack of evidence.

The application goes on to cite historical context linking both Godse and Savarkar ideologically. It asserts that both figures were staunch advocates of Hindu nationalism, considered Muslims and Christians as misfits, and viewed Mahatma Gandhi’s secularism and actions during Partition as a betrayal.

Gandhi’s plea refers to various academic sources and historical records to support his contentions. It claims that Savarkar propagated the two-nation theory as early as 1937 and further elaborated upon it in 1943, laying ideological groundwork for India's eventual Partition. He is also alleged to have expressed anti-Muslim views, especially during his incarceration, as per the references cited in the application.

Quoting from Savarkar’s 1963 book Six Glorious Epochs of Indian History, the application asserts that Savarkar encouraged the use of rape as a political tool, and had advocated for the capture and conversion of Muslim women as retribution.

Rahul Gandhi has filed this application as a preliminary objection before recording of plea in the defamation case. The application directly challenges Satyaki’s claim that Rahul Gandhi’s London speech—in which he referenced an excerpt allegedly written by Savarkar about assaulting a Muslim youth—was defamatory in nature.

Taking cognizance of the plea, Special Judge Amol Shinde has directed the complainant, Satyaki Savarkar, to submit his response to the allegations raised in Gandhi’s application.

The case continues to draw attention given the historical sensitivity and high-profile nature of the individuals involved. Further developments are expected upon the complainant’s reply and subsequent court hearings.
