A Judicial First Class Magistrate Court in Kunnamangalam, Kerala has denied bail to Shimjitha Musthafa, who is accused of abetting the suicide of U. Deepak, a 42-year-old salesman, after she posted a viral video alleging sexual misconduct against him. The bail plea was rejected on Tuesday, January 27, 2026.

The order was pronounced by Smt. Athira M, Judicial First Class Magistrate, who upheld the prosecution’s objections to bail, noting that the investigation is at a preliminary stage and releasing the accused could lead to tampering with evidence and influencing witnesses.

Shimjitha Musthafa has been charged under Section 108 of the Bharatiya Nyaya Sanhita (BNS), 2023 for abetment of suicide, a non-bailable and cognizable offence that carries punishment of up to 10 years’ imprisonment and a fine.

The case stems from a viral video recorded on January 16, 2026, in which Shimjitha alleged that Deepak had inappropriately touched her during a public bus journey in Kannur. The clip was widely shared on social media platforms, attracting significant public attention. Deepak was later found dead by suicide at his residence on January 18.

Following Deepak’s death, his mother filed a complaint with the police on January 19, and the Kozhikode Medical College Police registered an FIR against Shimjitha for abetment of suicide. She was arrested on January 21 and remanded to judicial custody.

During the bail hearing, the police remand report strongly opposed Shimjitha’s release, stating that she was aware of the possible consequences of posting the video and that letting her out could jeopardize the ongoing probe. The prosecution also noted that a forensic analysis of her mobile phone was still underway.

The defence counsel argued that Shimjitha had no prior acquaintance with the deceased and contended that the charge of abetment to suicide was not sustainable. However, the court was not persuaded by this submission and refused bail, directing that Shimjitha remain in custody as the investigation proceeds.

Legal experts note that the case highlights the serious implications of social media allegations, where posts alleging misconduct can have irreversible consequences before due legal process is completed. At the same time, charges under abetment provisions require the prosecution to demonstrate a direct or intentional role in causing the deceased’s act of suicide.


दीपक आत्महत्या मामले में शिमजिथा मुस्तफा की जमानत याचिका खारिज, केरल अदालत ने राहत देने से इनकार किया

कोझिकोड / कुन्नमंगलम:
केरल के कुन्नमंगलम स्थित न्यायिक प्रथम श्रेणी मजिस्ट्रेट अदालत ने शिमजिथा मुस्तफा की जमानत याचिका खारिज कर दी है। शिमजिथा पर यू. दीपक, 42 वर्षीय व्यक्ति, की आत्महत्या को उकसाने का आरोप है। अदालत ने यह आदेश 27 जनवरी 2026 को पारित किया।

यह आदेश न्यायिक प्रथम श्रेणी मजिस्ट्रेट अथिरा एम. द्वारा सुनाया गया। अदालत ने अभियोजन पक्ष की दलीलों को स्वीकार करते हुए कहा कि मामले की जांच अभी प्रारंभिक चरण में है, और इस स्थिति में आरोपी को जमानत देने से सबूतों से छेड़छाड़ और गवाहों को प्रभावित किए जाने की आशंका से इनकार नहीं किया जा सकता।

अभियोजन के अनुसार, 16 जनवरी 2026 को शिमजिथा मुस्तफा द्वारा एक वीडियो सोशल मीडिया पर साझा किया गया था, जिसमें उन्होंने आरोप लगाया था कि दीपक ने कन्नूर में सार्वजनिक बस यात्रा के दौरान उनके साथ अनुचित व्यवहार किया। यह वीडियो सोशल मीडिया पर तेजी से वायरल हो गया।

इसके दो दिन बाद, 18 जनवरी 2026 को दीपक ने आत्महत्या कर ली। इसके पश्चात दीपक की माता ने पुलिस में शिकायत दर्ज कराई, जिसके आधार पर कोझिकोड मेडिकल कॉलेज पुलिस ने शिमजिथा मुस्तफा के खिलाफ मामला दर्ज किया।

पुलिस ने शिमजिथा को 21 जनवरी 2026 को गिरफ्तार किया। उन पर भारतीय न्याय संहिता, 2023 की धारा 108 के तहत आत्महत्या के लिए उकसाने का आरोप लगाया गया है, जो कि गैर-जमानती अपराध है।

जमानत पर सुनवाई के दौरान अभियोजन पक्ष ने दलील दी कि आरोपी को रिहा करने से जांच प्रभावित हो सकती है, क्योंकि मोबाइल फोन और डिजिटल साक्ष्यों की फॉरेंसिक जांच अभी लंबित है। अदालत ने इन दलीलों से सहमति जताते हुए जमानत देने से इनकार कर दिया।
