A Judicial Magistrate First Class court in Mansa, Gandhinagar (Gujarat) has convicted journalist Ravi Nair in a criminal defamation case filed by Adani Enterprises Limited (AEL) and sentenced him to one year of simple imprisonment along with a monetary fine. The verdict followed a full trial examining allegations that Nair had published defamatory material against the Adani Group.

The case arose from a complaint by Adani Enterprises Ltd — the flagship company of the Adani Group — alleging that Nair disseminated a series of tweets and online publications containing false and defamatory statements intended to damage the company’s reputation among investors, regulators, and the public.

According to the court’s findings, the posts went beyond fair criticism and constituted assertions presented as factual allegations, including claims of corruption, regulatory manipulation, and political patronage linked to the Adani Group. The court held that such statements, when circulated widely on digital platforms, were capable of harming the company’s reputation.

Rejecting the defence that the statements were made in good faith or public interest, the magistrate observed that the accused failed to produce material evidence substantiating the serious allegations. The court noted that repeated postings over several months indicated a sustained attempt rather than isolated commentary.

The conviction was recorded under criminal defamation provisions (Section 500 IPC), with the court holding that the complainant company qualified as an “aggrieved person” under criminal procedure law. The court emphasised that freedom of speech is not absolute and must be balanced against the right to reputation.

Background Of The Case

  • The complaint against Ravi Nair dates back to 2021, when Adani Enterprises alleged defamatory digital publications.

  • Nair has been known as a freelance journalist contributing to independent media platforms and reporting on corporate and policy issues.

  • Earlier proceedings included summons and court appearances before the Gandhinagar court.

Current Status

The court has awarded a one-year jail sentence and fine; however, further legal remedies such as appeal remain available under criminal procedure law.

गुजरात के गांधीनगर जिले के मानसा स्थित न्यायिक मजिस्ट्रेट प्रथम श्रेणी अदालत ने पत्रकार रवि नायर को अडानी एंटरप्राइजेज लिमिटेड द्वारा दायर आपराधिक मानहानि मामले में दोषी ठहराते हुए एक वर्ष के साधारण कारावास और जुर्माने की सजा सुनाई है। यह फैसला मुकदमे की विस्तृत सुनवाई के बाद दिया गया।

मामला अडानी एंटरप्राइजेज लिमिटेड, जो अडानी समूह की प्रमुख कंपनी है, की शिकायत से संबंधित है। कंपनी ने आरोप लगाया था कि नायर ने सोशल मीडिया पोस्ट और ऑनलाइन लेखों के माध्यम से झूठे और मानहानिकारक आरोप प्रसारित किए, जिससे कंपनी की प्रतिष्ठा को नुकसान पहुँचा।

अदालत ने कहा कि संबंधित पोस्ट सामान्य आलोचना से आगे जाकर तथ्यात्मक आरोप के रूप में प्रस्तुत किए गए थे, जिनमें भ्रष्टाचार, नियामकीय हस्तक्षेप और राजनीतिक संरक्षण जैसे आरोप शामिल थे। अदालत के अनुसार इस प्रकार की व्यापक डिजिटल प्रसार वाली सामग्री से कंपनी की प्रतिष्ठा प्रभावित हो सकती है।

अदालत ने यह भी माना कि आरोपी आरोपों के समर्थन में पर्याप्त साक्ष्य प्रस्तुत नहीं कर सके। “सद्भावना” और “जनहित” की दलील स्वीकार नहीं की गई। अदालत ने कहा कि बार-बार किए गए पोस्ट एक निरंतर प्रयास का संकेत देते हैं।

यह दोषसिद्धि भारतीय दंड संहिता की धारा 500 (आपराधिक मानहानि) के तहत हुई। अदालत ने यह भी स्पष्ट किया कि अभिव्यक्ति की स्वतंत्रता पूर्ण नहीं है और प्रतिष्ठा के अधिकार के साथ संतुलित होनी चाहिए।
