Delhi Court Acquits Arvind Kejriwal in ED Summons Non-Compliance Cases

A Delhi Court on Thursday acquitted former Delhi Chief Minister and AAP supremo Arvind Kejriwal in two cases concerning the alleged non-compliance of summons issued by the Enforcement Directorate (ED) in the Delhi Excise Policy case. The verdict was pronounced by Additional Chief Judicial Magistrate Paras Dalal of the Rouse Avenue Courts. While the acquittal has been announced, a detailed order from the court is currently awaited.

The ED had filed two criminal complaints against Kejriwal, alleging wilful non-compliance under Section 174 of the Indian Penal Code, 1860. The agency moved the court after Kejriwal skipped multiple notices to join the investigation, specifically those issued for November 02 and December 21 of 2023, as well as January 03 and January 18 of 2024. Kejriwal had consistently maintained that these summons were illegal.

The prosecution had alleged that the liquor policy was implemented as part of a conspiracy to provide a wholesale business profit of 12 percent to certain private companies. The ED claimed this stipulation was absent from the minutes of the Group of Ministers (GoM) meetings. Furthermore, the agency alleged that Vijay Nair acted on behalf of Arvind Kejriwal and Manish Sisodia to coordinate with the South Group for extraordinary profit margins.

दिल्ली की एक अदालत ने गुरुवार को पूर्व मुख्यमंत्री और आप प्रमुख अरविंद केजरीवाल को दिल्ली आबकारी नीति मामले में प्रवर्तन निदेशालय (ईडी) के समन की कथित अनदेखी से संबंधित दो मामलों में बरी कर दिया। राउज एवेन्यू कोर्ट के अतिरिक्त मुख्य न्यायिक मैजिस्ट्रेट पारस दलाल ने यह फैसला सुनाया। हालांकि बरी करने की घोषणा कर दी गई है, लेकिन अदालत के विस्तृत आदेश का अभी इंतजार है।

ईडी ने केजरीवाल के खिलाफ भारतीय दंड संहिता, 1860 की धारा 174 के तहत जानबूझकर समन की अवहेलना करने के आरोप में दो आपराधिक शिकायतें दर्ज की थीं। एजेंसी ने तब अदालत का रुख किया जब केजरीवाल जांच में शामिल होने के लिए जारी किए गए कई नोटिस पर उपस्थित नहीं हुए, विशेष रूप से 02 नवंबर और 21 दिसंबर 2023, और 03 जनवरी एवं 18 जनवरी 2024 को जारी समन। केजरीवाल ने इन समन नोटिसों को लगातार अवैध बताया था।

अभियोजन पक्ष ने आरोप लगाया था कि शराब नीति को कुछ निजी कंपनियों को 12 प्रतिशत का थोक व्यापार लाभ देने की साजिश के तहत लागू किया गया था। ईडी का दावा था कि यह शर्त मंत्रियों के समूह (जीओएम) की बैठकों के मिनट्स में मौजूद नहीं थी। इसके अलावा, एजेंसी ने आरोप लगाया कि विजय नायर ने असाधारण लाभ मार्जिन के लिए साउथ ग्रुप के साथ समन्वय करने के लिए अरविंद केजरीवाल और मनीष सिसोदिया की ओर से काम किया था।
