A Delhi court on Saturday **acquitted prominent social activist and Medha Patkar in a criminal defamation case filed against her by V K Saxena — the current Lieutenant Governor of Delhi — holding that the prosecution failed to prove the allegations beyond reasonable doubt.

The nearly 20-year-old dispute stemmed from a complaint filed in April 2006 by Saxena, then the President of the National Council for Civil Liberties (NCCL), arising out of remarks allegedly made by Patkar on an India TV programme titled “Breaking News.” Saxena claimed that Patkar had made defamatory statements about him during the telecast — allegations that he later relied upon in his criminal complaint.

Court’s Verdict and Reasoning

Judicial Magistrate First Class Raghav Sharma of the Saket Courts delivered the acquittal, observing that:

  • The prosecution failed to produce legally admissible evidence establishing that Patkar made or published the defamatory remarks asserted in the complaint.

  • Original footage or devices containing the broadcast evidence were not brought on record, and no witness present at the alleged programme corroborated the claim.

  • On the record, Patkar was not shown to have been a panelist in the programme; only a pre-recorded video clip of her was played during the broadcast.

The court observed that absence of reliable and admissible evidence made it impossible to conclude beyond reasonable doubt that Patkar had made the contested statements, leading to her acquittal on the charge punishable under Section 500 of the Indian Penal Code (IPC).

Background of the Case

The case dates back to 2006, when Saxena filed a defamation complaint against Patkar, alleging that she had defamed him on Breaking News — a popular news show hosted by anchor Rajat Sharma. Saxena claimed that during the programme, Patkar had alleged that he and his NGO received civil contracts related to the Sardar Sarovar project, damaging his reputation.

The complaint was originally filed in an Ahmedabad court but was transferred to Delhi for trial in 2010. The matter remained pending for nearly two decades amid intermittent hearings.

Evidence Gaps and Court’s Observations

In his judgment, Magistrate Sharma highlighted significant lapses in the prosecution’s case:

  • Neither the original interview footage nor the recording device was produced for inspection in court, creating an evidentiary gap.

  • No eyewitness testimony from someone who saw Patkar making the alleged remarks was put on record.

  • India TV personnel confirmed that only a short pre-recorded clip of Patkar was aired and she did not participate live as a panellist.

The Magistrate noted that these omissions undermined the prosecution’s ability to meet the high threshold of proof required for criminal defamation.

Legal and Public Context

The Delhi court’s judgment comes against a backdrop of complex litigation over defamation and public discourse in India. Criminal defamation under IPC Section 500 involves punishment where statements made are found to be false and intended to harm reputation, and courts have often stressed the need for strict proof requirements, especially in matters involving media or political speech.

Medha Patkar — a longstanding leader of the Narmada Bachao Andolan and a well-known social activist — has faced legal consequences in previous defamation matters linked to Saxena’s complaints. In 2024, a Delhi court had convicted her in another related defamation case and sentenced her to imprisonment, though that conviction was mired in appeals and procedural disputes.

Reactions and Implications

Reaction from civil liberties groups and legal observers highlighted that the acquittal underscores the fundamental requirement for strict adherence to evidence standards in defamation prosecutions, particularly in cases involving media broadcasts and long-standing public figures.

The ruling is also expected to ease legal pressure on Medha Patkar in relation to this specific complaint, though others arising from similar conduct may persist.


नर्मदा बचाओ आंदोलन की नेता और सामाजिक सक्रियवादी मेधा पाटकर को दिल्ली की एक मजिस्ट्रेट अदालत ने शनिवार को दंडनीय मानहानि (क्रिमिनल डिफेमेशन) के आरोपों से बरी कर दिया, जो दिल्ली के राज्यपाल (LG) विनई कुमार सैक्सेना द्वारा लगभग 20 साल पहले दायर किया गया था।

अदालत का फैसला और कारण

साकेत कोर्ट की पहली श्रेणी की मजिस्ट्रेट न्यायाधीश राघव शर्मा ने अपने फैसले में कहा कि:

  • अभियोजन पक्ष वह अभिनीत और कानूनी रूप से मान्य साक्ष्य प्रस्तुत करने में असफल रहा है जिससे यह सिद्ध हो सके कि पाटकर ने वाक्यांश दिए थे।

  • मूल टीवी फुटेज या रिकॉर्डिंग डिवाइस पेश नहीं किया गया, जिससे आरोप सिद्ध नहीं हो सके।

  • टीवी कार्यक्रम में पाटकर पैनलिस्ट के रूप में उपस्थित नहीं थीं, केवल उनके पूर्व रिकॉर्ड किए गए क्लिप को ही दिखाया गया।

इन कारणों से अदालत ने भारतीय दंड संहिता की धारा 500 के तहत दायर मानहानि के आरोपों को संदेह से परे साबित न होने के आधार पर पाटकर को बरी कर दिया।

मामले की पृष्ठभूमि

यह मामला 2006 का है, जब सैक्सेना ने “ब्रेकिंग न्यूज़” नामक भारत टीवी के एक कार्यक्रम में पाटकर द्वारा कथित रूप से उनके खिलाफ अपमानजनक टिप्पणी करने का आरोप लगाया था। सैक्सेना ने दावा किया कि पाटकर ने कहा कि वह और उनकी NGO को सरदार सरोवर परियोजना से जुड़े अनुबंध मिले थे — जिसे उन्होंने मानहानि बताया।

इन साक्ष्य-गत खामियों के कारण अदालत ने अभियोजन की दलीलों को खारिज कर दिया।
