In a significant legislative step aimed at strengthening the legal profession, the Telangana Legislative Assembly on March 30, 2026, passed the Telangana Advocates Protection Bill, 2026, a law intended to ensure the safety, dignity, and independence of advocates in the State.


Objective of the Bill

The Bill has been introduced to address rising concerns over violence, intimidation, and harassment faced by lawyers during the course of their professional duties.

It seeks to:

  • Provide legal protection to advocates against acts of violence and obstruction
  • Ensure a safe working environment for legal professionals
  • Strengthen the administration of justice by protecting officers of the court

Key Provisions of the Bill

1. Protection Against Violence and Harassment

The Bill criminalises acts of:

  • Assault or use of criminal force against advocates
  • Threats, intimidation, or coercion
  • Obstruction in discharge of professional duties

Such acts are proposed to be treated as cognizable and non-bailable offences.

2. Definition of “Advocate” and Scope

The Bill defines an “advocate” broadly to include:

  • Practicing lawyers enrolled under the Advocates Act, 1961
  • Law officers and legal practitioners engaged in court-related duties

Protection extends to acts performed within or outside court premises, provided they are connected to professional work.

3. Compensation Mechanism

The legislation provides for:

  • Compensation to victims of violence against advocates
  • Recovery of compensation from the accused persons

This ensures both punitive and restorative justice.

4. Special Courts & Speedy Trial

The Bill envisages:

  • Establishment/designation of special courts
  • Expedited investigation and trial of offences

This is aimed at ensuring swift justice in cases involving attacks on lawyers.

5. Presumption Clause

In certain circumstances, the Bill introduces a legal presumption in favour of the advocate, shifting the burden onto the accused, thereby strengthening enforcement.


Statements by the Government

Speaking on the development, Duddilla Sridhar Babu, Minister for Information Technology, Electronics & Communication, Industry & Commerce, and Legislative Affairs, emphasised that:

  • Advocates are integral to the justice delivery system
  • Ensuring their safety is essential for upholding the rule of law
  • The Bill reflects the government’s commitment to protect legal professionals

Context and Need

The passage of this Bill comes amid increasing reports across India of:

  • Assaults on lawyers
  • Interference in legal proceedings
  • Threats to advocates handling sensitive cases

Several States have been considering similar legislation, making Telangana one of the leading States to enact a dedicated law for advocate protection.

तेलंगाना विधानसभा ने 30 मार्च 2026 को तेलंगाना एडवोकेट्स प्रोटेक्शन बिल, 2026 पारित किया, जिसका उद्देश्य राज्य में वकीलों की सुरक्षा, गरिमा और स्वतंत्रता सुनिश्चित करना है।


विधेयक का उद्देश्य

यह विधेयक वकीलों के खिलाफ बढ़ती हिंसा, धमकी और उत्पीड़न की घटनाओं को ध्यान में रखते हुए लाया गया है।

इसका उद्देश्य है:

  • वकीलों को कानूनी सुरक्षा प्रदान करना
  • सुरक्षित कार्य वातावरण सुनिश्चित करना
  • न्याय प्रणाली को मजबूत करना

विधेयक के प्रमुख प्रावधान

1. हिंसा और उत्पीड़न के खिलाफ सुरक्षा

विधेयक के तहत निम्न कृत्य अपराध माने जाएंगे:

  • वकीलों पर हमला या बल प्रयोग
  • धमकी या डराना
  • पेशेवर कार्य में बाधा

इन्हें संज्ञेय और गैर-जमानती अपराध बनाया गया है।

2. “एडवोकेट” की परिभाषा

इसमें शामिल हैं:

  • अधिवक्ता अधिनियम, 1961 के तहत पंजीकृत वकील
  • न्यायिक कार्य से जुड़े विधि अधिकारी

3. मुआवजा प्रावधान

  • पीड़ित वकीलों को मुआवजा दिया जाएगा
  • आरोपी से वसूली की जाएगी

4. विशेष न्यायालय

  • मामलों के त्वरित निपटान के लिए विशेष अदालतों का प्रावधान
  • शीघ्र जांच और सुनवाई

5. अनुमान (Presumption) प्रावधान

कुछ परिस्थितियों में वकील के पक्ष में कानूनी अनुमान लगाया जाएगा।


सरकार का बयान

मंत्री दुड्डिला श्रीधर बाबू ने कहा कि:

  • वकील न्याय प्रणाली का महत्वपूर्ण हिस्सा हैं
  • उनकी सुरक्षा कानून के शासन के लिए आवश्यक है
  • यह विधेयक सरकार की प्रतिबद्धता को दर्शाता है

यह विधेयक राज्यपाल की मंजूरी के बाद लागू होगा।
