In a significant observation concerning electoral processes, the Supreme Court has made it clear that no impediment will be allowed in the completion of the Special Intensive Revision (SIR) of electoral rolls being conducted by the Election Commission of India (ECI). The remarks came during hearings related to petitions concerning the West Bengal SIR exercise.

Speaking firmly during the proceedings, Chief Justice of India (CJI) Surya Kant stated that the Court may issue any necessary orders, clarifications, or interim directions, but the SIR process must not be obstructed in any state. He emphasised that this position should be “very clearly understood by all the states,” underscoring judicial concern about the smooth functioning of electoral administration.

The bench, comprising CJI Surya Kant, Justice Joymala Bagchi, and Justice N.V. Anjaria, was hearing a batch of petitions relating to the electoral roll revision process in West Bengal. After extensive arguments by multiple lawyers, the Court issued several directions and clarified that micro-observers appointed during the revision exercise only assist Electoral Registration Officers (EROs/AEROs) and do not possess final decision-making authority.

During the hearing, concerns were raised about alleged street violence, administrative challenges, and issues relating to deployment of micro-observers which, according to some submissions, were affecting the revision exercise. Responding to these issues, the Court reiterated that while necessary directions may continue to be issued, the completion of SIR cannot be stalled under any circumstances.

The Court is currently seized of petitions challenging the SIR exercise not only in West Bengal but also in Bihar, Tamil Nadu, Puducherry, and Kerala. Notably, even when directions were issued earlier regarding the Bihar revision process during election progression, the exercise itself was not halted.

Legal observers view the Court’s stance as reinforcing the importance of free, fair, and uninterrupted electoral roll management, which forms the backbone of democratic elections in India. The emphasis on ensuring administrative continuity while addressing grievances reflects the judiciary’s attempt to balance electoral integrity with procedural accountability.

चुनावी प्रक्रिया से जुड़े एक महत्वपूर्ण मामले में सुप्रीम कोर्ट ने स्पष्ट किया है कि मतदाता सूचियों के विशेष गहन पुनरीक्षण (Special Intensive Revision – SIR) की प्रक्रिया में किसी भी प्रकार की बाधा स्वीकार नहीं की जाएगी। यह टिप्पणी पश्चिम बंगाल में चल रही एसआईआर प्रक्रिया से संबंधित याचिकाओं की सुनवाई के दौरान की गई।

सुनवाई के दौरान भारत के मुख्य न्यायाधीश (CJI) सूर्यकांत ने कहा कि आवश्यक होने पर अदालत आदेश, स्पष्टीकरण या अंतरिम निर्देश जारी कर सकती है, लेकिन एसआईआर प्रक्रिया को किसी भी राज्य में बाधित नहीं होने दिया जाएगा। उन्होंने स्पष्ट किया कि सभी राज्यों को इस स्थिति को गंभीरता से समझना चाहिए।

सीजेआई सूर्यकांत, न्यायमूर्ति जॉयमाला बागची और न्यायमूर्ति एन.वी. अंजारिया की पीठ पश्चिम बंगाल एसआईआर से जुड़ी कई याचिकाओं पर सुनवाई कर रही थी। अदालत ने स्पष्ट किया कि माइक्रो-ऑब्जर्वर केवल चुनाव पंजीकरण अधिकारियों (EROs/AEROs) की सहायता के लिए होते हैं और उनके पास अंतिम निर्णय लेने का अधिकार नहीं होता।

सुनवाई के दौरान सड़क पर हिंसा के आरोप, प्रशासनिक कठिनाइयाँ और माइक्रो-ऑब्जर्वर की तैनाती से जुड़े मुद्दे उठाए गए। अदालत ने कहा कि आवश्यक निर्देश समय-समय पर दिए जा सकते हैं, लेकिन एसआईआर प्रक्रिया को रोका नहीं जा सकता।

यह भी उल्लेखनीय है कि अदालत के समक्ष केवल पश्चिम बंगाल ही नहीं बल्कि बिहार, तमिलनाडु, पुडुचेरी और केरल से जुड़े एसआईआर मामलों की याचिकाएँ भी लंबित हैं। बिहार में चुनावी प्रक्रिया के दौरान दिशा-निर्देश दिए जाने के बावजूद संशोधन प्रक्रिया नहीं रोकी गई थी।

 

कानूनी विशेषज्ञों के अनुसार अदालत का यह रुख स्वतंत्र, निष्पक्ष और सतत मतदाता सूची प्रबंधन की संवैधानिक आवश्यकता को रेखांकित करता है, जो लोकतांत्रिक चुनावों की आधारशिला है।
