Supreme Court Slams Centre Over Delay in Constituting National Road Safety Board

The Supreme Court has strongly criticized the Central Government for its failure to implement Section 215B of the Motor Vehicles Act, 1988, which mandates the constitution of the National Road Safety Board. A bench comprising Justice Abhay Oka and Justice Ujjal Bhuyan has granted a final six-month deadline to the Government to constitute the Board, stating that no further extension will be granted.

Under Section 215B, the Board is expected to advise both Central and State Governments on critical issues related to road safety and traffic management. Its responsibilities include recommending standards for vehicle design, weight, construction, safety equipment, and ensuring the safe and sustainable use of the transport ecosystem.

The Board is also tasked with promoting new vehicle technologies, ensuring safety of vulnerable road users, and supporting education and awareness programs for drivers and other road users. However, despite its statutory importance, the Board has existed only on paper, as the Chairperson and Members have not yet been appointed.

On 17th April 2025, the Court had instructed the Centre to submit an affidavit within two weeks detailing a timeline for constituting the Board. In response, the Government requested nine months to complete the process. Expressing dissatisfaction, the Court questioned why such a long delay was needed to implement a law passed in 1988.

Quoting the bench:

"We fail to understand why the Government of India needs such a long time to implement Section 215B of the Motor Vehicles Act, 1988. We grant time of 06 months from today to ensure that the National Road Safety Board is constituted. No further time shall be granted."

Additionally, the Court emphasized that the Board must be properly constituted before any of its recommendations can be implemented. It also directed all States and Union Territories to take immediate steps toward developing swift response protocols to ensure that road accident victims receive prompt assistance.

राष्ट्रीय सड़क सुरक्षा बोर्ड के गठन में देरी पर सुप्रीम कोर्ट ने केंद्र सरकार को लगाई फटकार

सुप्रीम कोर्ट ने केंद्र सरकार को कड़ी फटकार लगाते हुए कहा है कि वह मोटर वाहन अधिनियम, 1988 की धारा 215बी को लागू करने में विफल रही है, जिसमें राष्ट्रीय सड़क सुरक्षा बोर्ड के गठन का प्रावधान है। न्यायमूर्ति अभय ओका और न्यायमूर्ति उज्जल भुइयां की पीठ ने सरकार को बोर्ड के गठन के लिए अंतिम छह महीने का समय दिया है, यह स्पष्ट करते हुए कि अब कोई और समय नहीं दिया जाएगा।

धारा 215बी के तहत, बोर्ड का कार्य केंद्र और राज्य सरकारों को सड़क सुरक्षा और यातायात प्रबंधन से जुड़े विभिन्न पहलुओं पर सलाह देना है। इसमें वाहनों की डिज़ाइन, वजन, निर्माण, संचालन, सुरक्षा उपकरणों, तथा सड़क परिवहन प्रणाली के सुरक्षित और टिकाऊ उपयोग के लिए मानक निर्धारित करने जैसे कार्य शामिल हैं।

बोर्ड को नई वाहन तकनीक को बढ़ावा देने, कमजोर सड़क उपयोगकर्ताओं की सुरक्षा, और ड्राइवरों व अन्य सड़क उपयोगकर्ताओं के लिए जागरूकता कार्यक्रमों की सिफारिश करनी होती है। हालांकि, अपनी कानूनी अनिवार्यता के बावजूद यह बोर्ड अब तक सिर्फ कागज़ों पर ही मौजूद रहा है, क्योंकि अध्यक्ष और सदस्य नियुक्त नहीं किए गए हैं।

17 अप्रैल 2025 को कोर्ट ने केंद्र सरकार को आदेश दिया था कि वह दो सप्ताह के भीतर एक हलफनामा दायर करे जिसमें बोर्ड के गठन के लिए समय-सीमा का उल्लेख हो। इसके जवाब में सरकार ने नौ महीने का समय मांगा। इस पर नाराजगी जताते हुए कोर्ट ने पूछा कि 1988 में पारित कानून को लागू करने में इतनी लंबी देरी क्यों हो रही है।

न्यायालय की टिप्पणी:

"हमें समझ नहीं आता कि भारत सरकार को मोटर वाहन अधिनियम, 1988 की धारा 215बी को लागू करने में इतना समय क्यों लग रहा है। हम आज से 06 महीने का समय देते हैं ताकि राष्ट्रीय सड़क सुरक्षा बोर्ड का गठन सुनिश्चित किया जा सके। अब और समय नहीं दिया जाएगा।"

साथ ही, सुप्रीम कोर्ट ने यह भी स्पष्ट किया कि बोर्ड की सिफारिशों को लागू करने से पहले उसका विधिवत गठन होना आवश्यक है। कोर्ट ने सभी राज्यों और केंद्रशासित प्रदेशों को भी निर्देश दिया कि वे तेज रेस्पॉन्स प्रोटोकॉल विकसित करने के प्रभावी कदम उठाएं ताकि सड़क दुर्घटनाओं के पीड़ितों को तुरंत सहायता मिल सके।
