The Supreme Court of India has safeguarded the substantive rank, pay and administrative status of a Rajasthan Principal District Judge who had been transferred seven times in four years, holding that his frequent transfers could not be treated as punitive and that his judicial status must be preserved.

A Bench led by Chief Justice of India Surya Kant and comprising Justice Joymalya Bagchi granted the relief to Dinesh Kumar Gupta, a senior judicial officer of the Rajasthan higher judicial service, who challenged the numerous transfers since 2021. Gupta had approached the Supreme Court after contesting multiple postings that he said disrupted his service, seniority, and administrative position.

The petitioner was recently appointed as Presiding Officer of a Labour Court-cum-Industrial Tribunal, but his earlier rapid transfers — spanning various judicial positions and districts — raised concerns about the effect on his career prospects and service benefits. The Supreme Court’s order now ensures that his rank and pay scale remain protected, irrespective of the successive postings he received over the past few years.

In its reasoning, the Court noted that while judicial transfers are part of administrative functioning, they must not impinge upon a judge’s career prospects or service conditions unfairly, especially where the transfers are frequent and may appear inexplicable. The Supreme Court’s intervention reaffirmed that a judicial officer’s status and emoluments cannot be indirectly undermined through repeated relocations that can affect seniority, administrative responsibilities, or personal circumstances.

The judgment underlines the principle that the higher judiciary will not allow administrative actions to lead to de facto punishment or disadvantage for judicial officers without adequate justification. The petitioner has thus been assured that his substantive rank, pay, allowances, and related benefits will continue to be preserved in accordance with his seniority and service record, regardless of his posting history.

Legal experts say this order is an important affirmation of judicial service safeguards, emphasizing that administrative transfers should not be wielded as a tool to hamper the career trajectory of judicial officers. The matter reflects ongoing debates over ensuring a balance between administrative imperative and judicial independence in the subordinate judiciary.

भारत का सर्वोच्च न्यायालय ने राजस्थान के एक वरिष्ठ प्रधान जिला न्यायाधीश के रैंक, वेतन और प्रशासनिक स्थिति को संरक्षित रखा, जिनके खिलाफ 4 वर्षों में सात बार तबादलों को उन्होंने चुनौती दी थी। अदालत ने माना कि बार-बार तबादले उन्हें अनुचित रूप से दंडित नहीं करते हैं और उनके सेवा अधिकार सुरक्षित रहने चाहिए।

पीठ ने मुख्य न्यायाधीश सूर्यकांत और न्यायमूर्ति जॉयमाल्या बागची की संयुक्त सुनवाई में दिनेश कुमार गुप्ता को यह राहत दी, जिन्होंने 2021 से लगातार कई तबादलों को चुनौती दी थी। गुप्ता वर्तमान में लेबर कोर्ट-सह-इंडस्ट्रीयल ट्राइब्यूनल के अध्यक्ष अधिकारी के रूप में तैनात हैं, लेकिन उनके लगातार स्थानांतरणों ने उनके सेवा रिकॉर्ड और प्रशासनिक दायित्वों पर असर डाला था।

सुप्रीम कोर्ट ने अपने आदेश में कहा कि जबकि न्यायिक तबादले प्रशासनिक कार्य का हिस्सा हैं, फिर भी उस प्रकार के अत्यधिक और आवर्ती स्थानांतरण एक अधिकारी के कैरियर के अधिकारों और सेवा-स्थितियों को अनायास प्रभावित नहीं कर सकते। अदालत ने स्पष्ट किया कि वेतनमान, भत्ते और पदोन्नति-सम्बंधी स्थिति को बरकरार रखा जाना चाहिए, भले ही अधिकारी को विभिन्न पोस्टिंग्स पर भेजा गया हो।

आदेश ने यह भी रेखांकित किया कि न्यायिक सेवा में तबादले किसी अधिकारी को दंडित करने या उसकी प्रतिष्ठा को कम करने के साधन नहीं बन सकते। अतः गुप्ता का स्थान-आधारित सेवा रिकॉर्ड, वरिष्ठता और उपलब्धियों के आधार पर उनके रैंक और वेतन को सुरक्षित रखा गया।

 

कानूनी विशेषज्ञों का कहना है कि यह फैसला न्यायिक सेवा की सुरक्षा को मजबूत करता है और यह स्पष्ट करता है कि प्रशासनिक तबादलों को न्यायालय के स्वतंत्र निर्णयों और सेवाकाल के अधिकारों को बाधित नहीं करना चाहिए। यह मामला न्यायपालिका के निचले स्तर पर प्रशासनिक अधिकार और न्यायिक स्वतंत्रता के संतुलन पर निरंतर बहस का हिस्सा है।
