In the wake of multiple child fatalities in Madhya Pradesh and Rajasthan linked to the consumption of toxic cough syrups, a Public Interest Litigation (PIL) has been filed in the Supreme Court demanding an independent, court-monitored investigation and a comprehensive nationwide review of drug safety mechanisms.

The petition, filed by advocate Vishal Tiwari, urges the Court to direct the constitution of a National Judicial Commission or Expert Committee, chaired by a retired Supreme Court judge, to conduct an extensive inquiry into the manufacture, testing, and distribution of contaminated cough syrups containing Diethylene Glycol (DEG) and Ethylene Glycol (EG). These toxic compounds have been previously implicated in fatal incidents, raising serious concerns over persistent regulatory lapses.

Background

The PIL arises from alarming reports originating from Shivpuri in Madhya Pradesh and Barmer in Rajasthan, where several children reportedly died after consuming ColdRif Cough Syrup, manufactured by M/s Sresan Pharma Pvt. Ltd., a pharmaceutical company based in Tamil Nadu. Preliminary investigations conducted by local authorities and drug control departments have indicated suspected contamination in the syrup, rekindling fears about recurring failures in India’s drug quality control and export monitoring systems.

Reliefs Sought in the PIL

  • Formation of a National Judicial Commission or Expert Committee: The petitioner requests that this body, led by a retired Supreme Court judge and comprising experts in pharmacology, toxicology, and drug regulation, undertake a thorough investigation into the regulatory shortcomings that permitted the circulation of substandard cough syrups.

  • Transfer of Investigations to the CBI: To ensure an impartial and coordinated probe, the PIL seeks the transfer of all pending FIRs and investigations related to the child deaths caused by poisonous cough syrups to the Central Bureau of Investigation (CBI), supervised by a former Supreme Court judge. The petitioner highlights that multiple state-level inquiries have resulted in fragmented accountability, allowing toxic formulations to repeatedly reach consumers.

  • Immediate Recall and Seizure of Products: The PIL demands the immediate recall, seizure, and prohibition of the sale and distribution of all batches of ColdRif Cough Syrup and any other products manufactured by Sresan Pharma Pvt. Ltd. or its affiliates. It further seeks that these products undergo toxicological testing and verification by NABL-accredited laboratories before being permitted for sale or export.

  • Mandatory Pre-Distribution Quality Testing: The plea calls for pre-distribution quality testing of all cough syrups intended for domestic consumption and export, along with the establishment of a uniform safety audit mechanism across states.

  • Strengthening Regulatory Protocols: Directions are sought for the Central Drugs Standard Control Organisation (CDSCO) to enhance its inspection and approval processes, including real-time batch-level monitoring of medicinal formulations containing hazardous solvents such as DEG and EG.

The PIL underscores the urgent need to address systemic failures in drug safety oversight to prevent further tragedies involving toxic pharmaceuticals. The petitioner urges the Supreme Court to step in and ensure that a transparent, accountable, and scientifically robust investigation is conducted, coupled with strengthened regulatory safeguards.
