In a significant interim development, the Supreme Court of India has directed status quo on the cancellation and re-allotment of land originally granted to Patanjali Foods in Telangana. The order came while the Court was hearing the company’s challenge to the State government’s decision to cancel the allotment linked to an oil palm processing project.

The dispute relates to land in Suryapet district, Telangana, which had been allotted to Patanjali Foods Limited (formerly Ruchi Soya Industries) for establishing an oil palm processing unit under the National Mission on Edible Oils – Oil Palm (NMEO-OP) framework.

According to the State government, the allotment was cancelled in March 2025 due to alleged failure to meet cultivation targets and delays in setting up the processing facility. Subsequently, the land was re-allotted to another entity, prompting the company to approach the courts.

The company has argued that the government misinterpreted the Memorandum of Agreement, contending that non-establishment of the processing unit did not automatically justify cancellation of the factory zone. The petition also raises concerns regarding contractual interpretation and administrative fairness.

A Bench of Justice J.B. Pardiwala and Justice K.V. Viswanathan issued the status-quo order, effectively pausing further administrative action on the land while the legal challenge is considered.

Legal experts note that the case touches on broader issues involving government land allotment policies, contractual compliance, and judicial review of administrative decisions. The outcome may influence future disputes concerning industrial land allocation and public-private project implementation.


सुप्रीम कोर्ट का आदेश — तेलंगाना में पतंजलि फूड्स को भूमि आवंटन रद्द करने पर यथास्थिति बनाए रखें

एक महत्वपूर्ण अंतरिम आदेश में भारत के सुप्रीम कोर्ट ने तेलंगाना में पतंजलि फूड्स को आवंटित भूमि रद्द करने और पुनः आवंटन पर यथास्थिति बनाए रखने का निर्देश दिया है। यह आदेश कंपनी द्वारा राज्य सरकार के भूमि रद्दीकरण निर्णय को चुनौती देने वाली याचिका की सुनवाई के दौरान दिया गया।

यह विवाद तेलंगाना के सूर्यापेट जिले में उस भूमि से जुड़ा है, जिसे पतंजलि फूड्स लिमिटेड (पूर्व में रुचि सोया इंडस्ट्रीज़) को नेशनल मिशन ऑन एडिबल ऑयल्स – ऑयल पाम (NMEO-OP) योजना के तहत ऑयल पाम प्रोसेसिंग यूनिट स्थापित करने के लिए आवंटित किया गया था।

राज्य सरकार ने मार्च 2025 में कथित तौर पर खेती लक्ष्य पूरे न करने और प्रोसेसिंग यूनिट स्थापित करने में देरी का हवाला देते हुए आवंटन रद्द कर दिया था तथा भूमि किसी अन्य इकाई को दे दी गई।

कंपनी का तर्क है कि सरकार ने समझौता ज्ञापन (MoA) की गलत व्याख्या की है और प्रोसेसिंग यूनिट स्थापित न होना स्वतः भूमि रद्दीकरण का आधार नहीं बनता।

न्यायमूर्ति जे.बी. पारदीवाला और न्यायमूर्ति के.वी. विश्वनाथन की पीठ ने यथास्थिति बनाए रखने का आदेश दिया, जिससे अंतिम निर्णय तक भूमि संबंधी प्रशासनिक कार्रवाई स्थगित रहेगी।

 

कानूनी विशेषज्ञों के अनुसार यह मामला सरकारी भूमि आवंटन नीति, अनुबंधीय दायित्व और प्रशासनिक निर्णयों की न्यायिक समीक्षा जैसे महत्वपूर्ण प्रश्नों से जुड़ा है, जिसका प्रभाव भविष्य के औद्योगिक परियोजनाओं और भूमि आवंटन विवादों पर पड़ सकता है।
