Transparency Activist Anjali Bhardwaj Files Petition Against Rule Amendment

Anjali Bhardwaj, a transparency activist, has filed a petition challenging the December 2024 amendment to Rule 93(2)(a) of the Conduct of Elections Rules, 1961. The amendment places restrictions on public access to critical election documents and records such as CCTV footage and Presiding Officer's Diaries.

Supreme Court Takes Up the Case, Issues Notice to Union Government and Election Commission

The Supreme Court has issued a notice to the Union Government and the Election Commission of India regarding the petition filed by Bhardwaj. The Court will hear the matter on March 17, 2025.

Constitutional Violations Alleged in Petition

The petition claims that the amendment violates the right to information under Article 19(1)(a) and the right to life and personal liberty under Article 21 of the Indian Constitution. Bhardwaj argues that limiting access to essential election records undermines electoral transparency and public scrutiny.

Legal Relief Sought by the Petitioner

Bhardwaj seeks a declaration from the Supreme Court that the amendment is unconstitutional and illegal. She has also requested the Court to direct authorities to restore access to previously accessible election records and implement a time-bound mechanism for providing such documents.

Potential Impact on Electoral Transparency
Outcome of the case could have significant consequences on electoral transparency, particularly regarding the public’s right to access election-related documents. The case may set a legal precedent regarding the balance between transparency and governmental authority in the electoral process.
