Supreme Court Issues Contempt Notice To 51 Delhi Hospitals For Not Providing Free Treatment To Weaker Sections

The Supreme Court of India has issued contempt notices to 51 private hospitals in Delhi for allegedly failing to comply with its directions requiring them to provide free treatment to patients from economically weaker sections (EWS). The order was passed by a Bench comprising Justice Prashant Kumar Mishra and Justice N.V. Anjaria while monitoring compliance with earlier court directives regarding healthcare obligations of hospitals built on government land allotted at concessional rates.

According to the Court, the hospitals were required to reserve 10% of beds in the In-Patient Department (IPD) and 25% of services in the Out-Patient Department (OPD) for free treatment of EWS patients. These conditions formed part of the land allotment agreements through which private hospitals received land from government agencies such as the Delhi Development Authority (DDA) and the Land & Development Office (LDO) at concessional prices.

Show Cause Notices To Hospitals

The Court directed the 51 hospitals to show cause why contempt proceedings should not be initiated against them for violating the court’s earlier orders. The Bench also asked why concessional benefits granted by the government for land allotment should not be withdrawn in cases of non-compliance.

Some of the prominent hospitals that received notices include Sir Ganga Ram Hospital, BLK Max Hospital, Fortis Escorts Hospital, Moolchand Khairatiram Hospital, Centre for Sight, and Rajiv Gandhi Cancer Institute & Research Centre, among others.

Court Criticises Authorities For Lax Enforcement

The Supreme Court also expressed dissatisfaction with the Delhi government and land-owning agencies, noting that the authorities had acted “very casually” in enforcing compliance despite repeated communications regarding the hospitals’ violations. The Court observed that letters sent by the government to agencies such as DDA, LDO and the Municipal Corporation of Delhi (MCD) had either not been acted upon or had received no response.

Appointment Of Nodal Officer

To ensure proper implementation of its directions, the Court appointed the Health Secretary of the Government of NCT of Delhi as the Nodal Officer to coordinate action against the erring hospitals. The Court directed all relevant authorities—including DDA, LDO and MCD—to cooperate with the Nodal Officer and provide necessary information and assistance.

The Nodal Officer has been tasked with identifying lapses, initiating corrective measures, and reporting back to the Supreme Court if any authority fails to act against hospitals violating the court’s orders.

Background: 2018 Supreme Court Order

The present action stems from the Supreme Court’s 2018 ruling, which reaffirmed that private hospitals receiving government land at concessional rates must provide free treatment to EWS patients as part of their contractual obligations. The Court had warned that failure to comply with these conditions could result in contempt proceedings and possible cancellation of land concessions.

Next Hearing

The matter is scheduled for further hearing before the Supreme Court on March 24, when the hospitals are expected to respond to the contempt notices and explain the alleged violations.

Legal observers note that the Court’s strong stance underscores the judiciary’s continuing effort to ensure accountability of private healthcare institutions benefiting from public resources while safeguarding access to affordable healthcare for economically weaker citizens.

भारत के सुप्रीम कोर्ट ने दिल्ली के 51 निजी अस्पतालों को अवमानना (Contempt) का नोटिस जारी किया है, क्योंकि वे आर्थिक रूप से कमजोर वर्ग (EWS) के मरीजों को मुफ्त इलाज देने से संबंधित अदालत के आदेशों का पालन करने में विफल पाए गए हैं। यह आदेश न्यायमूर्ति प्रशांत कुमार मिश्रा और न्यायमूर्ति एन.वी. अंजारिया की पीठ ने पारित किया।

अदालत ने कहा कि जिन अस्पतालों को सरकारी जमीन रियायती दरों पर दी गई थी, उन्हें अपने IPD (इन-पेशेंट विभाग) में 10% बेड और OPD (आउट-पेशेंट विभाग) में 25% सेवाएं आर्थिक रूप से कमजोर वर्ग के मरीजों को मुफ्त उपलब्ध करानी होंगी। यह शर्त जमीन आवंटन समझौते का हिस्सा थी।

अस्पतालों से जवाब तलब

सुप्रीम कोर्ट ने इन 51 अस्पतालों से पूछा है कि अदालत के आदेश का उल्लंघन करने पर उनके खिलाफ अवमानना की कार्रवाई क्यों न शुरू की जाए और उन्हें दी गई सरकारी रियायतें क्यों न वापस ली जाएं।

जिन अस्पतालों को नोटिस जारी किया गया है उनमें सर गंगा राम अस्पताल, BLK Max अस्पताल, फोर्टिस एस्कॉर्ट्स अस्पताल, मूलचंद खैराती राम अस्पताल, सेंटर फॉर साइट और राजीव गांधी कैंसर संस्थान जैसे बड़े अस्पताल शामिल हैं।

सरकारी एजेंसियों को भी फटकार

सुप्रीम कोर्ट ने दिल्ली सरकार तथा जमीन आवंटित करने वाली एजेंसियों—DDA, LDO और MCD—की भी आलोचना की और कहा कि आदेशों के अनुपालन को लेकर इन संस्थाओं ने मामले को “बहुत ही लापरवाही से” लिया।

नोडल अधिकारी नियुक्त

अदालत ने इस मामले में कार्रवाई सुनिश्चित करने के लिए दिल्ली सरकार के स्वास्थ्य सचिव को नोडल अधिकारी नियुक्त किया और निर्देश दिया कि DDA, LDO और MCD सहित सभी संबंधित एजेंसियां उनके साथ सहयोग करें।

2018 के आदेश का अनुपालन

यह कार्रवाई सुप्रीम कोर्ट के 2018 के आदेश के अनुपालन की निगरानी के दौरान की गई है, जिसमें कहा गया था कि सरकारी जमीन पर बने निजी अस्पतालों को गरीब मरीजों को मुफ्त इलाज देना अनिवार्य होगा।
