In an important ruling concerning procedural discipline in litigation, the National Company Law Appellate Tribunal (NCLAT) has held that geographical distance between a lawyer and their clerk cannot justify delay in filing or re-filing an appeal. The tribunal emphasised that coordination difficulties arising from location differences cannot be treated as sufficient grounds for procedural delay.

The observation was made by Technical Member Barun Mitra while refusing to condone a 105-day delay in re-filing an insolvency appeal in the case titled Komal Rakshit Patel vs Vinod Tarachand Agrawal RP of Jay Formulation Ltd & Ors.

The appellant had attributed much of the delay to coordination challenges between counsel and clerk located in different cities. However, the tribunal rejected this explanation, stating that lack of geographical proximity cannot be cited to justify prolonged procedural delays.

The appeal had earlier been returned by the registry due to certain defects such as incomplete or unclear documents. Parties are generally expected to promptly rectify such defects and re-submit appeals within prescribed timelines. In this instance, the corrected appeal was filed significantly late, leading the tribunal to dismiss both the application for condonation of delay and the main appeal itself.

Legal observers say the ruling underscores the judiciary’s growing insistence on procedural efficiency, timely filings, and professional diligence, especially in insolvency matters where delays can have serious commercial implications.

एक महत्वपूर्ण फैसले में नेशनल कंपनी लॉ अपीलेट ट्रिब्यूनल (NCLAT) ने कहा है कि वकील और उनके क्लर्क के बीच भौगोलिक दूरी अपील दाखिल करने या पुनः दाखिल करने में देरी का उचित कारण नहीं हो सकती। ट्रिब्यूनल ने स्पष्ट किया कि अलग-अलग शहरों में होने से उत्पन्न समन्वय संबंधी कठिनाइयाँ न्यायालयीन समयसीमा चूकने का वैध आधार नहीं बन सकतीं।

यह टिप्पणी टेक्निकल सदस्य बरुण मित्रा ने उस समय की जब उन्होंने 105 दिन की देरी से पुनः दाखिल की गई दिवाला (इंसॉल्वेंसी) अपील में देरी माफ करने से इनकार कर दिया। मामला Komal Rakshit Patel vs Vinod Tarachand Agrawal RP of Jay Formulation Ltd & Ors. से संबंधित था।

अपीलकर्ता ने देरी का मुख्य कारण वकील और क्लर्क के अलग-अलग शहरों में होने के कारण समन्वय में कठिनाई बताया था। लेकिन ट्रिब्यूनल ने कहा कि भौगोलिक निकटता का अभाव लंबे प्रक्रियात्मक विलंब को उचित नहीं ठहरा सकता।

इससे पहले अदालत की रजिस्ट्री ने अपील में कुछ त्रुटियों—जैसे अधूरे या अस्पष्ट दस्तावेज—के कारण उसे वापस कर दिया था। सामान्यतः पक्षकारों से अपेक्षा की जाती है कि वे ऐसी त्रुटियों को शीघ्र सुधारकर अपील दोबारा दाखिल करें। इस मामले में संशोधित अपील 105 दिन की देरी से दाखिल हुई, जिसके चलते ट्रिब्यूनल ने देरी माफी आवेदन और मूल अपील दोनों खारिज कर दी।

 

कानूनी विशेषज्ञों के अनुसार यह फैसला न्यायालयों द्वारा समयबद्ध प्रक्रिया, पेशेवर जिम्मेदारी और मुकदमों की दक्षता पर बढ़ते जोर को दर्शाता है, विशेषकर दिवाला मामलों में जहाँ देरी का व्यापक आर्थिक प्रभाव पड़ सकता है।
