In a significant interim relief to Bollywood actor Salman Khan, the National Consumer Disputes Redressal Commission (NCDRC) has kept in abeyance the execution of bailable arrest warrants issued against him in a case concerning an alleged misleading advertisement linked to a pan masala brand.

Background of the Case

The matter originates from a consumer complaint filed before the District Consumer Disputes Redressal Commission, Jaipur-II, by advocate Yogendra Singh Badiyal. The complaint alleged that advertisements featuring Salman Khan for “Rajshree Elaichi” amounted to surrogate advertising of pan masala, thereby misleading consumers and violating provisions of the Consumer Protection Act, 2019.

It was contended that the product endorsed by the actor served as a proxy to promote pan masala—a product known to have serious health implications—thus constituting a misleading advertisement.

Issuance of Bailable Warrants

The District Consumer Commission had earlier issued bailable warrants against the actor after alleging non-compliance with its interim orders restraining such advertisements. These warrants were subsequently upheld by the Rajasthan State Consumer Disputes Redressal Commission.

The proceedings were also linked to alleged contempt under Section 72 of the Consumer Protection Act, 2019, with claims that the actor continued to be associated with the advertisements despite restrictions.

Proceedings Before NCDRC

Challenging these orders, Salman Khan approached the NCDRC. Taking cognizance of the plea, a bench headed by President Justice (Retd.) A.P. Sahi granted interim relief by:

  • Staying the execution of bailable warrants
  • Keeping further proceedings in abeyance
  • Directing the concerned consumer commissions to submit original records of the case for examination

The Commission observed that examining the records of both the District and State Commissions was necessary to properly evaluate the issues raised in the appeal.

Arguments by Salman Khan

The actor’s legal team argued that:

  • He had endorsed only a “silver-coated elaichi” product, not pan masala.
  • The complaint was misconceived and without jurisdiction, as misleading advertisement cases fall within the domain of the Central Consumer Protection Authority.
  • The initial orders were passed without proper notice, and coercive measures such as bailable warrants were issued prematurely.

It was also submitted that the proceedings suffered from procedural irregularities, including lack of service of orders and denial of certified copies.

Parallel Developments in Rajasthan High Court

In a parallel development, the Rajasthan High Court has also granted relief to the actor by staying proceedings before the consumer forum in the same matter.

Current Status

With the NCDRC’s interim order:

  • The bailable warrants remain suspended
  • The case proceedings are temporarily halted
  • The matter will be reconsidered after examination of the records

The case highlights growing judicial scrutiny over celebrity endorsements and misleading advertisements, particularly involving products with potential health risks.

बॉलीवुड अभिनेता Salman Khan को बड़ी राहत देते हुए National Consumer Disputes Redressal Commission (NCDRC) ने उनके खिलाफ जारी जमानती गिरफ्तारी वारंट के क्रियान्वयन पर रोक लगा दी है। यह मामला कथित रूप से पान मसाला से जुड़े भ्रामक विज्ञापन से संबंधित है।

मामले की पृष्ठभूमि

यह विवाद जयपुर स्थित जिला उपभोक्ता विवाद निवारण आयोग में दायर एक शिकायत से उत्पन्न हुआ, जिसमें आरोप लगाया गया कि “राजश्री इलायची” के विज्ञापन के माध्यम से पान मसाला का सरोगेट विज्ञापन किया जा रहा है।

जमानती वारंट जारी होने की पृष्ठभूमि

जिला आयोग ने पहले अंतरिम आदेशों का पालन न करने के आरोप में सलमान खान के खिलाफ जमानती वारंट जारी किए थे, जिन्हें बाद में राज्य आयोग ने भी बरकरार रखा।

यह कार्यवाही उपभोक्ता संरक्षण अधिनियम की धारा 72 के तहत अवमानना से भी जुड़ी हुई थी।

NCDRC में कार्यवाही

सलमान खान ने इन आदेशों को चुनौती देते हुए NCDRC का रुख किया। आयोग ने अंतरिम राहत देते हुए:

  • जमानती वारंट के क्रियान्वयन पर रोक लगाई
  • आगे की कार्यवाही को स्थगित किया
  • संबंधित आयोगों से मूल रिकॉर्ड प्रस्तुत करने का निर्देश दिया

आयोग ने कहा कि मामले की सही जांच के लिए रिकॉर्ड का परीक्षण आवश्यक है।

सलमान खान की ओर से दलीलें

अभिनेता की ओर से यह तर्क दिया गया कि:

  • उन्होंने केवल “सिल्वर-कोटेड इलायची” का प्रचार किया, पान मसाला का नहीं
  • शिकायत अधिकार क्षेत्र से बाहर और आधारहीन है
  • आदेश बिना उचित नोटिस के पारित किए गए
  • जमानती वारंट जैसे कठोर कदम समय से पहले और अनुचित थे

राजस्थान हाई कोर्ट में भी राहत

इसी मामले में राजस्थान हाई कोर्ट ने भी उपभोक्ता आयोग की कार्यवाही पर रोक लगाई है।

वर्तमान स्थिति

NCDRC के आदेश के बाद:

  • जमानती वारंट फिलहाल निष्प्रभावी हैं
  • कार्यवाही अस्थायी रूप से रुकी हुई है
  • रिकॉर्ड की समीक्षा के बाद आगे निर्णय लिया जाएगा

यह मामला विशेष रूप से सेलिब्रिटी विज्ञापनों और भ्रामक प्रचार पर बढ़ती न्यायिक सख्ती को दर्शाता है।
