The Supreme Court has reaffirmed that a suit filed seeking partition of joint family property cannot be dismissed at the preliminary stage under Order VII Rule 11 of the Civil Procedure Code (CPC) if a plea is made that such property falls under the exception to benami transactions.

The Court reiterated that a plaint can only be rejected under Order VII Rule 11(d) CPC if it is "ex facie barred by law", without requiring evidence. However, the determination of whether properties are benami or constitute joint family assets involves factual inquiries such as the source of funds and family arrangements, which cannot be resolved at the pleading stage and thus require a trial.

The case was heard by a bench comprising Justices Pankaj Mithal and Ahsanuddin Amanullah, involving a suit filed by the Respondents/Plaintiffs for partition, declaration, and injunction against the elder son and others. The plaintiffs claimed that the properties were joint family assets and thus exempt from the Benami Transactions (Prohibition) Act, 1988.

The Appellants/Defendants sought to reject the plaint under Order VII Rule 11 CPC, arguing that the suit was barred by the Benami Act and the Hindu Succession Act, 1955. Dissatisfied with the lower courts’ rulings, the defendants approached the Supreme Court.

The Supreme Court, through a judgment authored by Justice Pankaj Mithal, declined to interfere with the findings of the lower courts. The Court held that since the plea by the plaintiff stated the property was held for the benefit of the joint family, the case involved factual determinations and could not be dismissed at the preliminary stage.

Referring to Pawan Kumar vs. Babu Lal, (2019) 4 SCC 367, the Court emphasized that where a plea claims exemption under the Benami Act, it raises a disputed question of fact, requiring adjudication based on evidence. Hence, the plaint cannot be rejected solely on legal grounds at the stage of Order VII Rule 11 CPC.

Accordingly, the Supreme Court upheld the lower court’s decision and dismissed the appeals.

सुप्रीम कोर्ट: संयुक्त परिवार की संपत्ति के बंटवारे का वाद आदेश VII नियम 11 CPC के तहत प्रारंभिक चरण में खारिज नहीं किया जा सकता

सुप्रीम कोर्ट ने यह दोहराया है कि यदि यह दावा किया गया हो कि संपत्ति बेनामी लेन-देन के अपवाद के अंतर्गत आती है, तो संयुक्त परिवार की संपत्ति के बंटवारे के लिए दायर वाद को आदेश VII नियम 11 CPC के तहत प्रारंभिक चरण में खारिज नहीं किया जा सकता।

अदालत ने यह सिद्धांत दोहराया कि कोई वादपत्र केवल तभी खारिज किया जा सकता है जब वह "कानून द्वारा स्पष्ट रूप से अवरोधित" हो, और उसके लिए प्रमाण की आवश्यकता नहीं होती। हालांकि, यह तय करना कि संपत्तियाँ बेनामी हैं या संयुक्त परिवार की संपत्ति, ऐसे तथ्यात्मक जांच की मांग करता है जैसे कि धन का स्रोत, पारिवारिक व्यवस्थाएँ, जो केवल वादपत्र पढ़ने से तय नहीं की जा सकतीं और जिसके लिए ट्रायल आवश्यक होता है।

इस मामले की सुनवाई न्यायमूर्ति पंकज मित्तल और न्यायमूर्ति एहतिशामुद्दीन अमानुल्लाह की पीठ ने की, जिसमें प्रतिवादी/वादियों ने बंटवारा, घोषणा और निषेधाज्ञा की मांग को लेकर मुकदमा दायर किया था, जिसमें बड़े बेटे, उसकी पत्नी और अन्य लोगों के खिलाफ आरोप लगाए गए कि संपत्तियाँ संयुक्त पारिवारिक संपत्ति हैं और इसलिए वे बेनामी लेन-देन अधिनियम, 1988 के अपवाद में आती हैं।

अपीलकर्ता/प्रतिवादियों ने वादपत्र को आदेश VII नियम 11 CPC के तहत खारिज करने की मांग की थी, यह तर्क देते हुए कि यह वाद बेनामी लेन-देन (निषेध) अधिनियम, 1988 और हिंदू उत्तराधिकार अधिनियम, 1955 के तहत प्रतिबंधित है। निचली अदालतों के फैसले से असंतुष्ट होकर, प्रतिवादी सुप्रीम कोर्ट पहुँचे।

सुप्रीम कोर्ट ने, न्यायमूर्ति पंकज मित्तल द्वारा लिखित निर्णय में, निचली अदालतों के निष्कर्षों में हस्तक्षेप करने से इनकार कर दिया। अदालत ने माना कि चूंकि वादी द्वारा यह दावा किया गया था कि संपत्ति संयुक्त परिवार के लाभ के लिए रखी गई थी, इसलिए यह मामला तथ्यात्मक निर्धारण की मांग करता है और प्रारंभिक चरण में खारिज नहीं किया जा सकता।

अदालत ने पवन कुमार बनाम बाबूलाल, (2019) 4 SCC 367 मामले का हवाला देते हुए कहा कि यदि यह दावा किया गया हो कि वाद बेनामी लेन-देन अधिनियम के अपवाद से सुरक्षित है, तो यह एक विवादास्पद तथ्यात्मक प्रश्न बन जाता है, जिसका साक्ष्यों के आधार पर निपटारा किया जाना चाहिए। अतः, ऐसे वादपत्र को केवल विधिक आधार पर आदेश VII नियम 11 CPC के तहत खारिज नहीं किया जा सकता।

इस प्रकार, सुप्रीम कोर्ट ने निचली अदालत के निर्णय को बरकरार रखा और अपीलें खारिज कर दीं।
