SC to deploy AI for case listing and bench allocation

The Supreme Court of India is set to introduce Artificial Intelligence (AI) in its administrative functioning to handle case listing and bench allocation, a move that could significantly transform the Court’s internal processes.

According to reports, the initiative has been taken under the leadership of Surya Kant, the Chief Justice of India, with the aim of eliminating human intervention in the process of assigning cases and preparing cause lists.

End of human role in listing process

Currently, the Chief Justice of India acts as the “Master of the Roster”, meaning the CJI decides which bench hears a particular case. This power plays a crucial role in the Court’s functioning but has often drawn scrutiny and debate.

The proposed AI-based system will automate these processes by using software that can list cases and allocate them to benches without human discretion, thereby reducing administrative intervention and potential irregularities.

Administrative overhaul in the Supreme Court registry

The move comes after an internal administrative probe reportedly revealed systemic problems within the Supreme Court Registry, including:

Officials remaining in the same posts for long periods
Outdated technological systems
Administrative lapses in case allocation and listing

Following the probe, the Court initiated large-scale interdepartmental transfers of registry officials to dismantle entrenched administrative structures and improve efficiency.

Trigger behind the reform

The decision to introduce AI reportedly followed a procedural lapse noticed during a hearing before a bench comprising the CJI, Justice Joymalya Bagchi and Justice Vipul Pancholi.

The Bench was hearing a petition filed by Irfan Solanki, who challenged provisions of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, arguing that they conflicted with Section 111 of the Bharatiya Nyaya Sanhita, 2023.

During the proceedings, the State of Uttar Pradesh informed the Court that a nearly identical petition had already been dismissed earlier by a three-judge bench. Despite this earlier dismissal, a similar petition had again appeared before a different bench, exposing a flaw in the case-listing mechanism.

Taking serious note of the lapse, the CJI ordered a deeper administrative review, which eventually led to the decision to introduce an AI-based automated listing system.

The introduction of AI into the Supreme Court’s administrative functioning could mark a major technological reform in India’s judicial system.
