The right to personal liberty (Article 21) is a fundamental protection that cannot be overridden without proper justification.
The Immoral Traffic (Prevention) Act, 1956 (PITA) is intended for protection, not punishment, of victims.
The judgment reinforces that PITA cannot be misused to arbitrarily detain adult victims of sexual exploitation.
Detention requires concrete evidence of risk; the mere fact that a victim is alone or lacks family support is insufficient.

The FIR and charge sheet were vague and lacked attribution of criminal conduct to the appellant.
Section 3(1)(r) requires insult or intimidation with the intent to humiliate a Scheduled Caste or Scheduled Tribe member.
Section 3(1)(s) requires abuse “by caste name” in public view with intent denigrating the caste.
The Court observed that civil or procedural technicalities cannot substitute the substantive element of intent required under the SC/ST Act.

The Court applied precedent from Shajan Skaria v. The State of Kerala, clarifying standards for proving offences under the Act.

- It was recorded by a police officer, not a Magistrate, without explanation.
- The medical endorsement was written by the investigating officer, not the doctor.
- Medical evidence showed 99% burns with respiratory failure, casting doubt on the victim’s capacity to give a detailed statement.
The Court condemned the casual and mechanical approach of medical certification in dying declarations.

The decision aligns with Supreme Court jurisprudence cautioning against mechanical framing of charges under Section 306 IPC.

✅Sri Madhu Ram Deka v. The State of Assam & Another, 2026

The judgment reinforces that Section 143-A NI Act confers discretion, not an automatic right.
It emphasizes the need for a balanced approach, protecting accused persons from premature financial burden.

- Interim compensation is justified only where liability is prima facie apparent.
The decision safeguards against misuse of Section 143-A in cases involving:
